A Regular Meeting of the Standing Committee of Council on Planning and Environment was held on Thursday, March 17, 2005, at 2:30 p.m., in the Council Chamber, Third Floor, City Hall.

ADOPTION OF MINUTES
The Minutes of the Standing Committee on Planning and Environment meeting of February 17, 2005, were adopted.
RECOMMENDATION
1. 1246 - 1248 Lakewood Drive - Warning to Prospective Purchasers (File 2701)
The Committee had before it an Administrative Report dated February 16, 2005, in which the City Building Inspector recommended Council direct a 336D Notice be filed against the title to the property at 1246 - 1248 Lakewood Drive, in order to warn prospective purchasers of by-law violations and that the building has been used as an illegal marijuana grow operation on two occasions. The General Manager of Community Services recommended approval.
Peter Sweeney, Manager, Building Inspection Branch, reviewed the report.

THAT the Committee recommend to Council
THAT the City Clerk be directed to file a 336D Notice against the title to the property at 1246-1248 Lakewood Drive, Lot 4 Except the east 32 feet of Lot C, Block 135, District Lot 264A, Plans 1278 and 1771, PID 014-686-503 in order to warn prospective purchasers that this building has been used as an illegal marijuana grow operation on two occasions and there are contraventions of the Vancouver Building and Electrical By-laws related to this unapproved use.

The Committee had before it an Administrative Report dated February 25, 2005, in which the City Building Inspector recommended Council declare the building at 227 East 28th Avenue a nuisance and dangerous to public safety and order the registered owner to demolish the building and provide a chain-link fence around the property and also that staff be directed to file a 336D notice against the title to the property to warn prospective purchasers of by-law violations. The General Manager of Community Services recommended approval.
Peter Sweeney, Manager, Building Inspection Branch, reviewed the report and responded to questions relating to the cost of rehabilitating the building, timeframes for demolition and
reimbursement of costs if City action is required.MOVED by Councillor Louie
THAT the Committee recommend to Council
A. THAT Council declare that the building at 227 East 28th Avenue, Lot 7 Blocks 38 & 39 District Lot 632 Plan 1304, PID 014-683-245 is a nuisance and dangerous to public safety pursuant to Section 324A of the Vancouver Charter.
B. THAT Council approve the Resolution attached to Administrative Report Nuisance and Dangerous Building at 227 East 28th Avenue, dated February 25, 2005, and order the property owner to pull down and demolish the building and to provide a chain-link fence around the perimeter of the property within 30 days of a copy of the Resolution being served pursuant to Section 324A of the Vancouver Charter.
C. THAT in the event that the owner fails to comply with this order of Council, Council further orders and hereby authorizes the City Building Inspector, in his discretion, to carry out the work outlined in paragraph (B) above pursuant to Section 324A(2) of the Vancouver Charter.
D. THAT in the event of the failure of the owner to allow the City Building Inspector and/or his designate access to the site to carry out the work as outlined in paragraph (B) above, the Director of Legal Services is hereby authorized, in her discretion, to commence a legal action or proceeding in relation to the building located at 227 East 28th Avenue, and may, in her discretion, seek injunctive relief in that action or proceeding in order to bring the building and site into compliance with the City By-laws and Council's resolution.
E. THAT the City Clerk be directed to file a 336D Notice against the Certificate of Title to the property at 227 East 28th Avenue, in order to warn prospective purchasers that there are violations of the Standards of Maintenance and Vancouver Building By-law related to this property and that there is an order of Council against the property.

4. Capital Allocation to City-owned Cultural Facility: Vancouver East Cultural Centre (File 2005)
The Committee had before it an Administrative Report dated January 15, 2005, in which the Managing Director, Cultural Services, sought Council approval of a capital grant to the Vancouver East Cultural Centre (VECC) for Phase 1 capital improvements to the City-owned buildings at 1885-1895 Venables Street, along with support for a further City contribution to the future phases of the revitalization project and endorsement of the VECC's application to the Canada BC Infrastructure Program. In addition, Council was asked to approve extension of the Operating Lease Agreement term. The City Manager recommended approval.
Sue Harvey, Managing Director of Cultural Services, reviewed the report and responded to questions relating to the lease agreement and the endowment.

THAT the Committee recommend to Council
A. THAT Council support the capital expansion project for the City-owned buildings leased to the Vancouver East Cultural Centre at 1885-1895 Venables Street as outlined in Administrative Report, Capital Allocation to City-owned Cultural Facility: Vancouver East Cultural Centre, dated January 15, 2005.
B. THAT Council endorse the Vancouver East Cultural Centre Society's application to the Canada B.C. Infrastructure Works Program, noting that such endorsement does not commit the City to funding the local share of capital costs or any increased operating costs.C. THAT Council approve a "challenge" capital grant in the amount of $750,000 to the Vancouver East Cultural Centre to be applied to Phase 1 of its capital expansion project as outlined in Administrative Report, Capital Allocation to City-owned Cultural Facility: Vancouver East Cultural Centre, dated January 15, 2005, the grant to be subject to the Society securing the balance of funds necessary to complete the project to the satisfaction of the Directors, Office of Cultural Affairs and Facilities Design and Development; source of funds to be in advance of the 2005 City-owned Social Services and Cultural Facilities capital budget.
D. THAT Council indicate support for a further capital grant of $1.75 million to the Vancouver East Cultural Centre for Phases 2 ($750,000) and 3 ($1.0 million) of its capital expansion project as outlined in Administrative Report, Capital Allocation to City-owned Cultural Facility: Vancouver East Cultural Centre, dated January 15, 2005, with any such subsequent funding to be considered after a detailed report to Council on the appropriate funding sources and confirmation that the Society has secured the funds necessary to complete each phase of the project to the satisfaction of the Directors, Office of Cultural Affairs and Facilities Design and Development.
E. THAT Council approve a modification of the lease terms approved by Council September 11, 2003 regarding the proposed agreement between the City and The Vancouver East Cultural Centre by modifying the term from five years renewable for two further five-year terms to ten years with two further ten-year terms, and on such other terms and conditions to the satisfaction of the Directors of Legal Services, Real Estate and Cultural Affairs.

Council commended the Committee for its diligence and hard work to date.

Further to the request by Councillor Louie at the Council meeting of March 15, 2005, for a report back from the City Manager on the reallocation of resources within the contract with the City's street furniture provider to introduce recycling containers, he asked that the report include what Seattle is doing in Pioneer Square about this issue.
