SUBJECT:	Business License Hearing Panels for March 1, 15 and 31, 2005

RECOMMENDATION

THAT Council delegate the holding of the Business License Hearings presently scheduled for March 1 and 15, 2005, from 9:30 a.m. to 12:30 p.m., and March 31, 2005, from 7:30 p.m. to 10:30 p.m., to a panel of three Council Members, pursuant to Section 277.1 of the Vancouver Charter, as follows:

The Business License Hearings pursuant to Section 275 of the Vancouver Charter regarding referrals to Council by the Chief License Inspector for the year 2005 business licenses and the power to make a Council decision in relation to those hearings be delegated to:

March 1, 2005 - 9:30 a.m.
	Councillor Jim Green, Chair
	Councillor Peter Ladner
	Councillor Sam Sullivan
	Councillor Fred Bass, Alternate

March 15, 2005 - 9:30 a.m.
	Councillor Tim Louis, Chair
	Councillor Raymond Louie
	Councillor Tim Stevenson
	Councillor David Cadman, Alternate

March 31, 2005 - 7:30 p.m.
	Councillor Sam Sullivan, Chair
	Councillor Tim Stevenson
	Councillor Fred Bass
	Councillor Ellen Woodsworth, Alternate

Should any of the above Members of Council be unable to attend the hearings, the hearings and the power to make a Council decision in relation to those hearings be delegated to the remaining two Councillors and alternate Councillors.

CITY MANAGER'S COMMENTS

The City Manager RECOMMENDS approval of the foregoing.

COUNCIL POLICY

Section 277.1 of the Vancouver Charter gives Council the power to delegate the holding of a Business License Hearing under Section 275 or Section 278, or an appeal under Section 277, by Resolution to one or more Council Members. On November 30, 1999, Council adopted a procedure relating to Business License Hearings whereby the Hearings will generally be conducted before a panel of three Members of Council, although Council may designate that a Hearing be conducted before a panel comprised of a greater number of Members of Council.

PURPOSE

To establish panels for the Business License Hearings presently scheduled for March 1, 15 and 31, 2005.

DISCUSSION

The Vancouver Charter confers on Council the power to delegate the holding of Business License Hearings to one or more Members of Council. Council must designate, by Resolution, Members of Council who will deal with each specific Hearing.

FINANCIAL IMPLICATIONS

There are no financial implications.

CONCLUSION

Staff recommend that Council pass the recommendation contained in this report.
