RECOMMENDATION
A. THAT Mr. Peter Judd, Deputy City Engineer, be appointed as Deputy Approving Officer;
FURTHER THAT Mr. Tom Timm, General Manager of Engineering Services, remain as Deputy Approving Officer, with the authority of this position when both the Approving Officer (Mr. Scobie) and the Deputy Approving Officer (Mr. Judd) are absent from work.
The following is submitted for the INFORMATION of Council:
B. THAT pursuant to the Development Permit Board and Advisory Panel By-law, Mr. Peter Judd, Deputy City Engineer, is an alternate member on the Development Permit Board to Mr. Timm, General Manager of Engineering Services, and Mr. Ian Adam remains as an alternate member on the Development Permit Board to the General Manager of Engineering Services.

COUNCIL POLICY
Under Section 77 of the Land Title Act, Council must appoint an Approving Officer to carry out the duties pertaining to subdivision as governed by the Act (and subject to the provisions of the City's Subdivision By-law). Council has also appointed a Deputy Approving Officer to function in the absence of the Approving Officer.
Pursuant to the Strata Property Act, Council has delegated to the Approving Officer its approval authority for specified applications involving conversion of previously-occupied buildings.
Under the Development Permit Board (the Board) and Advisory Panel By-law, members of the Board are defined by position. The By-law provides that each member may also have one (or in some instances more than one) alternate member, to act in the absence of the member.
These alternate members are prescribed with varying precision in the By-law.
PURPOSE
This report seeks Council Appointment of Mr. Judd as Deputy Approving Officer and the retention of Mr. Timm as a Deputy Approving Officer. It also advises Council of changes to the Development Permit Board composition as a consequence of senior management personnel changes in Engineering Services.
BACKGROUND
Mr. Timm was previously appointed by Council to the position of Deputy Approving Officer. He has also been an alternate member on the Development Permit Board to the General Manager of Engineering Services. These need to be revised as a consequence of Mr. Timm's new position as General Manger of Engineering Services.
DISCUSSION
1. Subdivision
Presently, Mr. Rick Scobie, Director of Development Services, is the Approving Officer for the City and Mr. Tom Timm is the Deputy Approving Officer. Mr. Timm was appointed to this position when he was the Deputy City Engineer. Prior to Mr. Timm, Mr. MacGregor was the Deputy Approving Officer when he was the Deputy City Engineer.
In scheduling vacations and other periods of absence, when both the Approving Officer and Deputy Approving Officer have both been unavoidably absent, Council has appointed another official - the General Manager of Engineering Services - as Deputy Approving Officer, for temporary periods.
With the appointment of a new Deputy City Engineer and the need for a more lasting and robust administrative arrangement without the need for future, temporary appointments, it is advisable that there be two Deputy Approving Officers. The Approving Officer therefore recommends that Mr. Judd, Deputy City Engineer, be appointed as Deputy Approving Officer, authorized to act in place of the Approving Officer when he is absent from work. It is also recommended that Mr. Timm, General Manager of Engineering Services, be appointed as a second Deputy Approving Officer, the intent being that he would act in those infrequent instances when both the Approving Officer and other Deputy Approving Officer are absent from work.
2. Development Permit Board (the Board)
The Board and Advisory Panel By-law No. 5869 identifies the General Manager of Engineering Services as one of the four members of the Board. The By-law also provides for alternate members to the General Manager of Engineering Services and specifies either the Deputy City Engineer or an Assistant City Engineer.
In his former position as Deputy City Engineer, Mr. Timm was an alternate member. As the General Manager of Engineering Services, he is now a member. Mr. Ian Adam, Assistant City Engineer, has been and will remain as an alternate member. Mr. Judd, Deputy City Engineer, is also now an alternate member to the General Manager of Engineering Services.
Based on the foregoing, the composition of the Board is now:
Member and Chair: Rick Scobie, Director of Development Services
Alternate: Any other member or alternate member
Member: Brent MacGregor, Deputy City Manager
Alternate: Jacquie Forbes-Roberts, General Manager of Community Services
Member: Tom Timm, General Manager of Engineering Services
Alternate: Peter Judd, Deputy City Engineer
Alternate: Ian Adam, Assistant City Engineer
Member: Larry Beasley, Co-director of Planning
Alternate: Ann McAfee, Co-director of Planning
CONCLUSION
Mr. Judd is now the Deputy City Engineer. It is appropriate that subdivision responsibilities previously assigned to this position be assigned to him. It is also prudent to have Mr. Timm remain as a Deputy Approving Officer, for those infrequent periods when both Mr. Scobie and Mr. Judd are absent from work.
As Deputy City Engineer, Mr. Judd is also now an alternate Development Permit Board member to the General Manager of Engineering Services
