SUBJECT:
Closure of a Portion of Lane South of 1956 West 5th Avenue West of Cypress Street
RECOMMENDATION
THAT Council close, stop-up and convey all that portion of the lane south of Lot A and Lot B, Both of Lot 5, Block 266, District Lot 526, Plan 5855, as shown hatched on the plan attached hereto as Appendix A, subject to the following conditions:
1. The abutting owners to pay $56,250.00 Plus GST if applicable for the 500 square foot (46.5 square metres) portion of lane to be closed in accordance with the recommendation of the Director of Real Estate Services;
2. The subject lane to be closed is to be consolidated with the said Lot A and Lot B and other adjacent lands to form a single parcel to the satisfaction of the Director of Legal Services;
3. The abutting owners to be responsible for any plans, documents and Land Title Office fees;
4. The sale proceeds to be credited to the Property Endowment Fund (the APEF@);
5. Any agreements are to be to the satisfaction of the Director of Legal Services;
6. No legal right or obligation shall be created and none shall arise hereafter, until the documents are executed by the parties thereto.
COUNCIL POLICY
The authority for closing and disposing of streets and lanes is set out in the Vancouver Charter.
PURPOSE
The purpose of this report is to seek Council authority to close, stop-up and convey a portion of lane south of 1956 West 5th Avenue, west of Cypress Street.
BACKGROUND
The said lane was dedicated by Plan 5855 on August 23, 1927. The said lane has never been opened and there is no record that any utilities have ever been installed under or over the lane.
DISCUSSION
The owner of said Lot A and Lot B has made an application to purchase the subject lane that is excess to our needs for consolidation with said Lot A and Lot B and the adjacent West ½ of Lot 6, Block 266, District Lot 526, Plan 590.
As noted the lane has never been opened and remains physically part of the south rear yard of said Lot A and Lot B. The unopened lane is in mid-block and not accessible from any street. The General Manager of Engineering Services has abandoned plans for a lane through this block. Further dedications in the block will not be sought.
The Director of Real Estate Services has negotiated a sale of the 500 square feet (46.5 square metres) of lane as shown hatched on Appendix AA@ for $56,250.00 Plus G.S.T. if applicable.
The Director of Real Estate Services advises that the sale price of $56,250.00 represents fair market value for the 500 square feet (46.5 square metres) of lane to be conveyed. The applicants will be responsible for all costs, plans, documents and Land Title Office fees required to complete the conveyance.
CONCLUSION
The General Manager of Engineering Services in consultation with the Director of Real Estate Services RECOMMENDS approval of the foregoing.
