A Regular Meeting of the Standing Committee of Council on Planning and Environment was held on Thursday, October 7, 2004, at 2:00 p.m., in Council Chamber, Third Floor, City Hall.

ADOPTION OF MINUTES
The Minutes of the Standing Committee on Planning and Environment meeting of September 16, 2004, were adopted.
PRESENTATION
1. Vancouver International Airport Update (File 8025)
Larry Berg, President and CEO, Anne Murray, Vice-President Community and Environment Affairs, and Jane Fleming, Director and the Citys nominee to the YVR Board, gave an update on Vancouver International Airport, specifically airport operations and capital projects, environmental and community projects.
Mr. Berg and Ms. Murray responded to questions regarding taxation and rent, the relationship with regional transportation infrastructure and municipal and regional planners, plans for residential use of land, noise issues particularly in the Marpole area, reducing pollution from idling airplanes, the airport improvement fee, employment, commercial development in the next two years, growth patterns for cargo and parcel post, and implications for ridership of the future RAV line.

THAT Council receive for information, an update on Vancouver International Airport, as presented at the Standing Committee on Planning and Environment meeting on October 7, 2004.

RECOMMENDATION
2. 7690 Fraser Street Warning to Prospective Purchasers (File 2701)
The Committee had before it an Administrative Report, dated September 13, 2004, in which the City Building Inspector requested approval to file a 336D Notice against the title to 7690 Fraser Street, to warn prospective purchasers of By-law violations.
Peter Sweeney, Manager of Building Inspections Branch, reviewed the report and responded to questions regarding extensions to the notice, implications for the new owner and potential options for the completion of repairs.
Surinder Dutta, Property Owner, indicated changes had not been done due to family commitments over the summer, followed by his hospitalization and heart surgery in August. Since that time, Mr. Dutta has had no income and is not in a financial position to do the required changes. Mr. Dutta further indicated that the bill of sale for the house shows that the sundeck is not authorized.

THAT the City Clerk be directed to file a 336D Notice against the title to 7690 Fraser Street (Lot 1, Block 2, District Lot 326B, Plan 1672) in order to warn prospective purchasers that there are contraventions of the Zoning and Development and Vancouver Building By-laws related to this building

3. 827 East 18th Avenue Warning to Prospective Purchasers (File 2701)
The Committee had before it an Administrative Report dated September 15, 2004, in which the City Building Inspector requested approval to file a 336D notice against the title to 827 East 18th Avenue to warn prospective purchasers of By-law violations and to request approval to seek injunctive relief.
Peter Sweeney, Manager of Building Inspections Branch, reviewed the report and responded to questions regarding time limits and delaying injunctive action.
John Bekiou, Property Owner, indicated he and his family have been having a series of planning, personal and infrastructure problems related to the house. Due to these problems, they have been unable to live in the house and are facing associated financial issues as well. Mr. Bekiou requested Council not approve the injunctive relief as they are actively preparing building permits and liaising with the City Planning department.
Mr. Sweeney indicated because Mr. Bekiou has been actively liaising with City Planning, and, in response to a statement by Councillor Louie, staff will not be pursuing injunctive relief immediately.MOVED by Councillor Louis
THAT the Committee recommend to Council
A. THAT the City Clerk be directed to file a 336D Notice against the title to 827 East 18th Avenue (Lot 9, Block 79, District Lot 301, Plan 187) in order to warn prospective purchasers that there are contraventions of the Zoning and Development and Vancouver Building By-laws related to this building.
B. THAT the Director of Legal Services is hereby authorized, in her discretion, to commence a legal action or proceeding in relation to the premises located at 827 East 18th Avenue and may, in her discretion, seek injunctive relief in that action or proceeding, in order to bring this building into compliance with City By-laws.

1. Maintaining Respect for Democracy in Vancouver (File 1251)
The following Motion was submitted by Councillor Sullivan at the Regular Council meeting on October 5, 2004. Councillor Louie called Notice under Section 5.4(c) of the Procedure By-law.

WHEREAS,
- During the September 28th Vancouver City Council meeting a group of people attended and due to their shouting and abusive behavior prevented the Council from conducting business for one hour.
- The Counsul General of France had come to address the Council and one of Vancouvers fine musicians was scheduled to perform and neither of them were able to present to the Council.
- Democratic government is an achievement that deserves the respect of all its citizens.
- The democratic processes of Vancouver work for the benefit of all its citizens and should not be compromised by any group.
- In previous Council meeting during this term Council has tolerated interruptions by protesters give the impression that it is acceptable to disrupt the functioning of a democratic institution.
- Our Council has mechanisms to allow everyone with concerns about the citys decisions to be heard in an organized and civilized manner.
THEREFORE, BE IT RESOLVED THAT City staff be asked to provide options on ways to ensure that democratic processes be respected and permitted to function and that the rules of Council be observed.
