Warning to Prospective Purchasers

RECOMMENDATION

The General Manager of Community Services RECOMMENDS approval of the foregoing.

COUNCIL POLICY

Section 336D of the Vancouver Charter provides a mechanism whereby the City of Vancouver can warn prospective purchasers of contraventions of City By-laws relating to land or a building or structure. It provides that if the City Building Inspector observes a condition that he considers to be a contravention of a By-law relating to the construction or safety of buildings; or as a result of that condition, a building or structure is unsafe or unlikely to be usable for its expected purpose; or is of a nature that a purchaser, unaware of the contravention, would suffer a significant loss or expense if the By-law were enforced against him, he may recommend to City Council that a resolution be considered directing the City Clerk to file a notice against the title to the property in the Land Title Office.

PURPOSE

The purpose of this report is to request approval to file a 336D Notice against the title to 7690 Fraser Street to warn prospective purchasers of By-law violations.

BACKGROUND

The building at 7690 Fraser Street was constructed in 2002 as a one family dwelling with an attached two-car garage. It is located in an RT-2 (two family dwelling) District.

DISCUSSION

As a result of a referral, our inspection services reported that an approximate 10' x 20' deck with cover was under construction at the rear, extending the full width of the second floor on the east side of the building without permits, in contravention of the Zoning and Development and Vancouver Building By-laws. The approved plans for the building indicated a 3'10" deck, extending the full width of the building. On January 12, 2004, the owners were ordered to stop work immediately and either make application for the required permits or remove the unapproved construction. At the request of the owners, an extension of time was granted.

A Development and Building Permit was issued on April 16, 2004 for exterior alterations to remove the unapproved extension of the deck and to provide a 6.42' x 6' landing at the northeast corner.

A recent inspection has indicated that the unapproved portion of the deck has not been removed and that the property is for sale.

The owners are being ordered to remove the unapproved portion of the deck and the roof addition.

CONCLUSION

As the building is listed for sale, it is recommended that a 336D Notice be filed against the title to the property so that any prospective purchasers will be warned that there are violations of the Zoning and Development and Vancouver Building By-laws.
