RECOMMENDATION

COUNCIL POLICY

In 1986, Council approved payment-in-lieu parking provisions.

PURPOSE

On April 20, 2004, Council gave approval in principal for an application at 1226 Homer Street under DE 408152, pursuant to Section 4.12 of the Parking By-law, to waive seven parking spaces required by Section 4.1.2 of the By-law and to make payment-in-lieu. The applicant has proposed minor changes to the development which may result in a decrease in the required parking, and therefore, a corresponding decrease in the number of waived spaces to be provided through payment-in-lieu from 7 to 6 spaces. The earlier report did not permit the Director of Legal Services the discretion to bring forward an amending By-Law for fewer than 7 parking spaces. This report seeks Council approval for the waiver of up to the original seven parking spaces which will enable the Director of Legal Services to bring forward a bylaw for fewer spaces if appropriate. A review of this application found that payment-in-lieu is appropriate, given the site constraints and the lack of opportunity to provide parking by another means.
