- 1226 Homer StreetRECOMMENDATION
A. THAT Council approve in principle, for deposit into the Payment-in-Lieu Parking Reserve, the offer of payment-in-lieu in the amount of up to $101,500 by Howard Bingham Hill Architects Ltd. for the waiver of up to 7 parking spaces required by Section 4.1.2 of the Parking By-law.
B. THAT the Director of Legal Services be requested to bring forward a by-law to amend Schedule A of the Parking By-law pursuant to Section 4.12.5 to effect this waiver.
COUNCIL POLICY
In 1986, Council approved payment-in-lieu parking provisions.
PURPOSE
On April 20, 2004, Council gave approval in principal for an application at 1226 Homer Street under DE 408152, pursuant to Section 4.12 of the Parking By-law, to waive seven parking spaces required by Section 4.1.2 of the By-law and to make payment-in-lieu. The applicant has proposed minor changes to the development which may result in a decrease in the required parking, and therefore, a corresponding decrease in the number of waived spaces to be provided through payment-in-lieu from 7 to 6 spaces. The earlier report did not permit the Director of Legal Services the discretion to bring forward an amending By-Law for fewer than 7 parking spaces. This report seeks Council approval for the waiver of up to the original seven parking spaces which will enable the Director of Legal Services to bring forward a bylaw for fewer spaces if appropriate.
