Liquor Primary Application for Outdoor Patio Seating

RECOMMENDATION

GENERAL MANAGER'S COMMENTS

The General Manager of Community Services RECOMMENDS approval of the foregoing.

COUNCIL POLICY

Council Policy requires that amendments to existing Liquor Primary (Club Lounge) Licenses are subject to a public consultation and a Good Neighbour Agreement.

PURPOSE

The Greater Vancouver Media Association is requesting a Council resolution endorsing their application for a 24 seat Liquor Primary Outdoor Patio on private property at the Greater Vancouver Media Association, 695 Cambie Street.

BACKGROUND

The applicant has been operating at this location for approximately 11 years and is open only to members and their guests. The patio will be located directly beside the entry to the establishment and the applicant will not have any music or speakers on the patio (outdoor speakers are not permitted per Section 25.5 of the License Bylaw). The applicant wishes to eventually use this area as a licensed smoking area.

The current hours of operation are:
Monday to Saturday: 11:30 a.m. to 1:30 a.m.
Sunday: 11:00 a.m. to 12:00 midnight
The proposed hours of operation for the patio are:

Liquor Control & Licensing Branch (LCLB) Regulations and Policies
Branch regulations allow liquor service between the hours of 9:00 a.m. to 4:00 a.m. seven days a week for Liquor Primary Licenses. All changes/amendments to the liquor license hours of service are subject to local government support. All previous Branch policy has been eliminated. The LCLB has no specific policy for patios.

Area Surrounding Premises
The subject premises are located in the Downtown (DD) Zoning District. The surrounding area is primarily office towers and a mixture of hotels, restaurants, retail and other commercial uses (refer to Appendix A).

There are five hotel lounges/pubs (881 total seats), two club lounges (222 total seats, including this application), two venues (2443 total seats) and approximately 11 licensed restaurants within the 1000 ft. survey area.

DISCUSSION

Staff have no issues with the proposed patio. The location and 11:00 p.m. closing time of the patio are unlikely to impact any adjacent businesses or residents.

RESULTS OF NOTIFICATION

On June 3, 2004, a sign was erected on the site advising area residents and businesses of the application and where to send concerns or comments. Staff allowed 2 weeks for the community to respond with their concerns or support for the application. There have been no responses to the site sign.
COMMENTS

The Police Department have no issues with this application.

The Development Services Department would require a Development Permit for any proposed outdoor seating patio.

The Environmental Health Department has some concerns with maintenance issues in the kitchen, mostly to do with the ceiling and recommend that the patio closes and vacates by 11:00 p.m.

The Social Planning Department & Housing Centre have no concerns.

CONCLUSION

Given the proposed patio location and the 11:00 p.m. closing time, staff do not anticipate any significant impacts from the operation of this patio. Therefore, staff are Recommending Council endorse the applicant's request fro a 24 seat Liquor Primary patio.
