A Regular Meeting of the Standing Committee of Council on Planning and Environment was held on Thursday, February 26, 2004, at 2:00 p.m., in Committee Room No. 1, Third Floor, City Hall.

ADOPTION OF MINUTES
The Minutes of the Standing Committee on Planning and Environment meeting of January 29, 2004, were adopted.
VARY AGENDA
The Committee agreed to vary the order of the agenda so staff could advise why Item 4 was withdrawn. For ease of reference, the minutes are recorded in numerical order.
RECOMMENDATION
1. 4693 Bellevue Drive - Warning to Prospective Purchasers (File 2701)
The Committee had before it an Administrative Report dated December 2, 2003, in which the City Building Inspector recommended Council direct a 336D Notice be filed against the title to the property at 4693 Bellevue Drive in order to warn prospective purchasers of By-law violations regarding the property. The General Manager of Community Services recommended approval.
Peter Sweeney, Manager, Building Inspection Branch, reviewed the report and responded to questions relating to the history of the complaint.

THAT the Committee recommend to Council
THAT the City Clerk be directed to file a 336D Notice against the title to the property at 4693 Bellevue Drive (Lot 1 of C, Block 135, District Lot 540, Plan 5755) in order to warn prospective purchasers that there are contraventions of the Zoning and Development and Vancouver Building By-laws related to this building.

The Committee had before it an Administrative Report dated January 30, 2004, in which the City Building Inspector recommended Council direct a 336D Notice be filed against the title to the property at 2610 Charles Street in order to warn prospective purchasers of the unsafe condition of the building due to chemical contamination from the production of methamphetamines. The General Manager of Community Services recommended approval.
Peter Sweeney, Manager, Building Inspection Branch, reviewed the report and along with Doug Roberts, District Building Inspector, and Carlene Roberts, Manager, By-law Administration, responded to questions relating to the effects of the chemicals, the state of the premises and possible dangers, financial implications for the City and the legal process.

THAT the Committee recommend to Council
THAT the City Clerk be directed to file a 336D Notice against the title to the property at 2610 Charles Street (Lot 2, Block 36 DL Sec 33 N E Qtr THSL Plan 4396 PID 003-149-731) in order to warn prospective purchasers that this building had been used as an illegal methamphetamine lab and was closed by the Police, Fire and City Inspection Staff due to unsafe conditions resulting from chemical contamination.

3. 2434 Main Street - Guys & Dolls Billiards Ltd.
Application for Liquor Primary License - Billiard Hall (File 2612-1)The Committee had before it an Administrative Report dated October 28, 2003, in which the Chief License Inspector sought Council advice regarding an application for a Liquor Primary License (Billiard Hall & Arcade) at 2434 Main Street. The General Manager of Community Services recommended approval of the recommendation to not endorse the application.
Guy Gusdal, License Coordinator, reviewed the report and with Barb Windsor, Deputy Chief License Inspector, responded to questions relating to the notification process, current and possible policies relating to liquor licensing, and hours of operation
Antonio Gomes, Applicant, and Jonathan Baker, Applicant's Counsel, spoke in favour of the application.
Their comments included:
· review of history and solid reputation of establishment;
· Council should not be talking about policy, but should be talking about law;
· Council should not ignore the results of public process: a vast majority (including the BIA) are either in favour or do not care about the application;
· established policy is to deal with applicants on a case-by-case basis;
· zoning by-law does not disallow use; liquor licensing by-law doesn't preclude this use;
· Applicant has spent a great deal on improvements;
· the process has been costly and onerous; the Applicant expressed concern that he was not made aware that he would have to apply to the City as well as the Province;
· Guys & Dolls has been instrumental in the process to improve the Mount Pleasant area.Sid Tan spoke in favour of the application noting the following:
· as a long time patron, Guys & Dolls has changed in a positive way;
· the desire to have a beer while playing pool is a reasonable request and a relaxing form of entertainment;
· approving the application speaks to the kind of City we want;
· the operators are good citizens and run a good business.In response to Council questions, Mr. Gusdal and Jacquie Forbes-Roberts, General Manager, of Community Services, clarified the following:
· the liquor licensing process, including the role of the Province;
· the process required to amend by-laws or establish a pilot project, including concerns relating to a "one of" situation;
· mechanisms and limitations relating to liquor licensing enforcement;
· that there is no specific policy relating to the minimum distance of community centres to drinking establishments.MOVED by Councillor Green
THAT the Committee recommend to Council
THAT decision on the application by Guys & Dolls Ltd. for a 93 seat Liquor Primary License (Billiard Hall/Arcade) at 2434 Main Street be postponed to provide time for staff to work with Legal Services and bring a memo back to Council on how to enable this specific application to go forward as a pilot project without negatively impacting on-going liquor licensing work.
