There is no Council policy directly applicable to the proposed amendment.

PURPOSE AND SUMMARY

This report recommends an amendment to the C-2 District Schedule of the Zoning and Development By-law to correct a recently-detected error.

BACKGROUND/DISCUSSION

Staff have identified a typographical error in the package of amendments to the C-2 District Schedule recently approved at a Public Hearing on October 23, 2003 and submitted for enactment on December 2, 2003.

Once enacted, there will be an error in section 4.5.1(b) which deals with side yard setbacks where a site is adjacent to an R district.

Clause 4.5.1 (b) (ii) will state the side yard setback at or above the fourth storey, shall be 16.8 m (55.1 ft.). The correct setback, as illustrated in Figure 3 of the Schedule, is 10.7 m (35.1 ft.).

Normally such typographical errors are dealt with in packages of miscellaneous text amendments. However, this proposed amendment should not wait for the next package of amendments which, if needed, will be many months away.

Draft by-law wording is contained in Appendix A.

CONCLUSION

The proposed amendment to the C-2 District Schedule (following enactment of a recent package of amendments) will correct an error to provide clarity in the interpretation of required side yard setbacks. It is recommended that the Director of Current Planning be instructed to make application to amend the Zoning and Development By-law, that the application be referred to Public Hearing, and that it be approved.
