Minor CD-1 Text Amendments - 1601 West Georgia Street/1601-1650 Bayshore Drive
RECOMMENDATION
THAT the Director of Current Planning be instructed to make application to amend CD-1 By-law No. 7232 for 1601 West Georgia Street/1601-1650 Bayshore Drive to permit Child Day Care Facility and above-grade bicycle parking generally in accordance with Appendix A, and that the application be referred to a Public Hearing;
FURTHER THAT the Director of Legal Services be instructed to prepare the necessary by-law generally in accordance with Appendix A, for consideration at the Public Hearing.

The General Manager of Community Services RECOMMENDS approval of the foregoing.

PURPOSE AND SUMMARY
This report recommends CD-1 By-law No. 7232 (#321) for 1601 West Georgia Street/1601-1650 Bayshore Drive be amended to add Child Day Care Facility as a permitted use, inadvertently omitted when the by-law was created, and further amended to allow for above-grade bicycle storage.
DISCUSSION
Child Day Care Facility: A development permit application for a mixed used development including the Bayshore Gardens Childcare Centre at 1610 Bayshore Drive is in process. It has been discovered that Child Day Care Facility is not listed as a permitted use in the CD-1 by-law for this site. Day care was always an intended use in this CD-1, indeed prior to enactment of the CD-1 the applicant was required to enter into legal agreements to provide and convey to the City a 47-space fully finished daycare facility along with an operating subsidy if required by Council.
At the time of enactment of the CD-1 By-law, zoning use terms and definitions were being refined and, as a result of an oversight, the new use term Child Day Care Facility was not included.
Above-grade Bicycle Parking: Due to site characteristics, a portion of the bicycle storage is proposed to be located above grade which is supported by staff for this project. To exclude this area from floor area calculation requires a further amendment to the By-law.
Staff cannot issue a development permit for the current project unless the By-law is amended generally in accordance with Appendix A.
CONCLUSION
The proposed amendments to CD-1 By-law No. 7232 will enable issuance of a development permit appropriate to the intent of the By-law. It is recommended that the Director of Planning be instructed to make application to amend the By-law and that the application be referred to Public Hearing.

Section 6 Floor Area and Density
- Amend section 6.3(d) to allow a specified* portion of bicycle storage (above base surface) to be excluded from floor area calculations.
