SUBJECT:
"Provincial Liquor Control and Licensing: New Regulations".
Based on Council's discussion of agenda Item 2 on the March 27, 2003 meeting of the Standing Committee on Planning and Environment, staff have brought forward an alternative to Recommendation A (refinement of Liquor Store process) and a new Recommendations J, K & L (Sunday hours) for Council's consideration.
Liquor Stores:
RECOMMENDATION A:
THAT with respect to development applications for liquor stores, Council rescind the current Beer and Wine Store and Specialty Wine Store guidelines and approve guidelines generally as outlined or referred to in Appendix A as the basis for review of all Liquor Stores selling "only" Beer, or "only" Wine,
FURTHER, THAT Council instructs the Director of Planning to favourably consider development applications for Liquor Stores selling beer and wine, or hard liquor to only those sites in the city currently approved as Liquor Stores.
If the above amendment is moved and accepted then Appendix A should also be amended as follows:
"That the development permit application review process for Liquor Stores selling "only" beer or "only" wine be as follows:"
[Note: Approval of the forgoing would result in applicants with a "Liquor Store" proposals currently in process, as of April 8, 2003, be given the option to declare their proposal a single product (beer or wine) specialty store. Full service liquor, beer & wine or "only" liquor stores would be reviewed on the basis of the new council policy.]
Sunday Hours:
Proposed new recommendation, RECOMMENDATION J:
THAT Council instructs the Chief License Inspector to immediately process and approve, on a 4 month temporary basis, all applications requesting an hours of operation extension on Sunday nights to 2:00 AM for all Cabarets, except businesses with recent serious enforcement issues.
[Note: This would result in cabarets without any enforcement issues (approximately 45 establishments) being eligible to apply for and receive extended operating hours on Sunday. The majority of these cabarets are situated in the downtown peninsula and along Broadway in close proximity to densely populated residential properties.]
Proposed new recommendation, RECOMMENDATION K:
THAT Council instructs the Chief License Inspector to immediately process and approve, on a 4 month temporary basis, all applications requesting an hours of operation extension on Sunday nights to the same hours of operation as on Friday and Saturday nights for all Liquor Primary establishments, except those operating as a Cabaret and businesses with recent serious enforcement issues.
[Note: This would result in the majority of Neighbourhood Pubs, most hotel pubs and lounges and the private clubs with hours of service beyond midnight on Friday and Saturday nights being eligible to apply for and receive extended operating hours on Sunday, provided there is no recent, serious enforcement issues. There approximately 209 of these licenses in the city, without an extensive review it is difficult to estimate how many would be eligible to apply.]
Proposed new recommendation, RECOMMENDATION L:
THAT Council request staff to report back, shortly after the temporary period has expired or sooner, on the feasibility of implementing permanent hours of operation extensions as outlined above including a proposed public consultation strategy.
