RECOMMENDATION
THAT the Director of Current Planning be instructed to make application to amend CD-1 By-law No. 8131 to correct errors generally in accordance with Appendix A, and that the application be referred to Public Hearing;
FURTHER THAT the Director of Legal Services be instructed to prepare the necessary by-law for consideration at the Public Hearing.

PURPOSE AND SUMMARY
This report recommends amendments to CD-1 By-law No. 8131 (#402), to correct errors created when the By-law was amended in October, 2002.
BACKGROUND
In 1999, this site was rezoned from I-3 (high technology industry) to CD-1 to permit development of the Great Northern Technology Park. The owner, Finning International, intended to sell the property to developers. Allocations of land uses and densities within this large CD-1 were relatively open to provide flexibility to future developers.
Finning subsequently sold properties to a developer and a consortium of local educational institutions, while retaining ownership of a portion of the site that is currently for sale.
In October, 2002, Council approved and enacted an application by the Director of Current Planning to apportion the permitted allocations of uses and densities to new sub-areas to reflect the new ownerships. This will allow separate owners to proceed with development applications or with applications to amend the CD-1 for their particular sub-areas.
DISCUSSION
The by-law that amended the CD-1 includes an incorrect table reflecting earlier discussions between staff and the owners. The correct table was included in Appendix A of the staff report dated September 17, 2002, but unfortunately was not used in the posted draft by-law. This error was not noticed until after the by-law was enacted.
There was a further oversight that two additional tables in the CD-1 should have been amended to reflect the new sub-areas.
To correct these problems, three tables outlined in Appendix A should replace the same three tables in the CD-1. These corrections will not change the total allocations of uses and densities within the whole site.
CONCLUSION
Three tables in CD-1 By-law No. 8131 for 655 Great Northern Way need to be replaced to correct errors created when the By-law was last amended. Staff recommend that the Director of Current Planning be instructed to apply to amend the CD-1 By-law and that the application be referred to Public Hearing.
