There is no Council policy directly applicable to this amendment.

PURPOSE AND SUMMARY

This report recommends an amendment to CD-1 By-law No. 7649 (#355) for the former Oakherst Private Hospital site at 7400 Oak Street to include a Parking By-law relaxation provision consistent with more recent CD-1 by-laws in Oakridge/Langara and elsewhere.

BACKGROUND

The 1.9 hectare (4.7 acre) former Oakherst private hospital site was rezoned on November 22, 1996 from RS-1 One-Family Dwelling District to CD-1 Comprehensive Development District to permit Multiple Dwellings and Multiple Conversion Dwelling. The rezoning conformed with Council adopted policies under the 1995 Oakridge Langara Policy Statement.

The form of development for the site was approved by Council on June 17, 1997, and a development permit was issued for townhouses and multiple dwellings, along with the restoration and conversion of a residential heritage building. After a long delay, construction is now underway on Phase 1 on the eastern side of the site under the original development permit.

On September 9, 2002, a development application was filed seeking changes to the form of development for the westerly portion of the site only. That is the subject of a companion report.

DISCUSSION

The development application proposes a rearrangement of the parking layout that would need a relaxation of requirements under the Parking By-law. However, the CD-1 By-law for 7400 Oak Street does not contain such a relaxation provision.

Since 1999, most CD-1 by-laws in Oakridge/Langara and across the city have included a Parking By-law relaxation provision to provide similar flexibility for unique circumstances as is available in standard zoning districts. A relaxation clause is now often added to old CD-1 By-laws when they are amended to accommodate redevelopment. A similar clause should be added to the CD-1 for 7400 Oak Street to provide needed flexibility in considering the revised form of development.

CONCLUSION

Staff conclude that, consistent with most newer CD-1 By-laws, a Parking By-law relaxation clause should be added to the CD-1 for 7400 Oak Street. It is recommended that staff be instructed to make application to amend the CD-1 By-law, and that the application be referred to a Public Hearing and be approved.

PROPOSED TEXT AMENDMENT TO CD-1 BY-LAW NO. 7649

An amending by-law will be prepared generally in accordance with the following:

8 Off-Street Parking and Loading

8.1 Off-street parking and loading must be provided, developed and maintained in accordance with the RM-4 provisions of the Parking By-law, except that a minimum of 1.75 off-street parking spaces for every dwelling unit in a multiple dwelling of less than 4 storeys must be provided, and a minimum of one parking space for each dwelling unit in a multiple conversion dwelling must be provided.

8.2 The Director of Planning may relax, upon advice of the City Engineer, any provision of section 8.1 where it is determined that no adverse impacts will be created for surrounding sites.
