STANDING COMMITTEE OF COUNCIL
ON PLANNING AND ENVIRONMENT

OCTOBER 24, 2002

A Regular Meeting of the Standing Committee of Council on Planning and Environment was held on Thursday, October 24, 2002, at 2:00 p.m., in Committee Room No. 1, Third Floor, City Hall.

RECOMMENDATION

1. Warning to Prospective Purchasers of 975 Ringwood Avenue (File 2701)

The Committee had before it an Administrative Report dated October 3, 2002, in which the City Building Inspector recommended a 336D Notice be filed against the title to the property at 975 Ringwood Avenue in order to warn any prospective purchasers of by-law violations in regard to the property. It was also recommended that the Director of Legal Services be authorized to commence legal proceedings if she deems it appropriate to do so.

The General Manager of Community Services recommended approval of the foregoing.

Peter Sweeney, Manager, Building Inspection, with the aid of photographs, reviewed the work which has been carried out on the subject property without the necessary permits being obtained. Mr. Sweeney provided information regarding the current ownership of the property and advised a 336D Notice should be placed on Title in the event the property is listed for sale.

2. Proposed Amendment to Subdivision By-law No. 5208 (File 5303/113)

The Committee had before it an Administrative Report dated September 23, 2002, in which the Subdivision Approving Officer recommended approval of an application to reclassify the property at 8190 Chester Street for the purpose of subdivision. The General Manager of Community Services also recommended approval.

Dave Murphy, Subdivision Coordinator, was present to respond to questions.

3. Promotional Inserts from Outside Recycling Organizations in the 2003 Garbage and Recycling Collection Calendar Mailing (File 3756/3758)

The Committee had before it an Administrative Report dated October 3, 2002, in which the General Manager of Engineering Services sought Council's approval to include promotional material from the Rechargeable Battery Recycling Corporation in the 2003 garbage and recycling collection calendar mailing. A request by the Salvation Army for the inclusion of promotional material regarding its clothing recycling program into the same mailing was also put forward for Council's consideration.

Kevin Van Vliet, Solid Waste Management Engineer, and Brian Davies, Assistant City Engineer - Solid Waste, responded to questions concerning options for providing all non-profit clothing recycling organizations the opportunity to have promotional materials included in the City's 2003 collection calendar mailing. It was noted that additional insertions into the mailing should be small in number in order that it not be treated as "junk mail" by recipients and also to reduce mailing costs to the City.

A. THAT Council approve the insertion of promotional material from the Rechargeable Battery Recycling Corporation in our 2003 garbage and recycling collection calendar mailing.

B. THAT Council approve the insertion of a single sheet of promotional material, at the discretion of Engineering Services staff, for non-profit/charitable organizations which operate clothing recycling programs, in our 2003 garbage and recycling collection calendar mailing.

4. Additions to the Major Road Network (File 5560-1)

The Committee had before it an Administrative Report dated October 8, 2002, in which the General Manager of Engineering Services recommended that Burrard Street from Hastings to Broadway be designated as an addition to the Major Road Network (MRN), including extensions to other existing MRN streets for network continuity.

Wayne Pledger, Strategic Transportation Planning Engineer, provided an overview of the report, and responded to questions regarding whether MRN status for Burrard will result in additional funding for the Burrard Bridge upgrade, and whether it will result in increased motorist capacity on the street.

Beverley Ballantyne spoke in opposition to the recommendation to add Burrard Street to the major road network, noting it would result in increased capacity. She also noted that Burrard Street does not qualify as a major road network street in that it does not link to other municipalities in the region. Ms. Ballantyne noted that TransLink's focus is on road construction and their policies put motorists' priorities first. She further submitted that adding Burrard to the network would be a step backward and would also take away the City's decision-making power in regard to future initiatives for the street.

Mr. Pledger, along with Ian Adam, Assistant City Engineer - Streets, and Judy Rogers, City Manager, responded to questions concerning issues and concerns raised by Ms. Ballantyne. Staff also responded to questions regarding whether the City was authorized to remove streets from the Major Road Network, once they have been designated as such.

1. Closing of volumetric portions of Georgia Street adjacent to Lot 291, False Creek, Plan BCP ____, [Costco]

1. The City of Vancouver is the owner of all the streets and lanes lying within the limits of the City of Vancouver;

2. There is a proposal to develop Lot 291, False Creek, Plan BCP _______ for commercial/retail purposes;

3. The proposal seeks to make use of a volumetric portion of Georgia Street, below the Georgia Street Viaduct, adjacent to the said Lot 291;

4. The owner of said Lot 291 has applied to lease the volumetric space below the Georgia Street Viaduct;

5. The said portion of Georgia Street was dedicated by the deposit of Plan BCP ___________;

6. The said volumetric space below the Georgia Street Viaduct is not required for municipal purposes;

7. To provide for the registration of said lease, it is necessary to raise a title to the portion of Georgia Street to contain the volumetric lease;

8. To enable the volumetric lease to be registered it is necessary for Council to close and stop-up the volumetric portion of Georgia Street to be leased.

THEREFORE BE IT RESOLVED THAT the Director of Legal Services be authorized to make application on behalf of the City of Vancouver, to raise title in the name of the City of Vancouver to that portion of road dedicated by the deposit of Plan BCP ______ and included within the bold outline on a Reference Plan attested to by Gary Sundvick, B.C.L.S., representing a survey completed on the 11th day of October 2002, marginally numbered DWG: 2688-RD2 REV.1., a reduced copy of which is attached hereto; and

BE IT FURTHER RESOLVED THAT all those volumetric portions of Georgia Street included within the heavy outlines and illustrated isometrically on a plan of a survey completed on the 11th day of October 2002, attested to by Gary Sundvick, B.C.L.S. and marginally numbered DWG 2688-Vol. 2 REV. 2, a reduced copy of which is attached hereto, be closed, stopped-up and leased to the abutting owner of Lot 291, False Creek, Plan BCP _______. The lease to be to the satisfaction of the General Manager of Engineering Services and the Director of Legal Services.
