SUBJECT: Local Improvements Subsequent Procedure - June 11, 2002

RECOMMENDATION

A. THAT the projects "by petition" in Court #606 and #609 be approved.

B. THAT projects by "Initiative Principle" in Court #607 be approved except for the Defeated Items.

C. THAT Special Items in Court #607, Items #4, and#37 and Court #608, Item #1 be Withdrawn and that Special Item in Court #607, Item #39 be approved as described in this report.

COUNCIL POLICY

Policies governing the Local Improvement process are set out in the Vancouver Charter and Local Improvements Procedure by-law.

PURPOSE

Projects by Petition and on the Initiative Principle have been advanced under the provisions of the Local Improvements Procedure By-law and will come before a Court of Revision on June 11, 2002.

Court #607, Item #4, Pavement & Curbs & Trees & Bulges
North Kent Avenue from Crompton Street to Victoria Drive

There are seven City owned assessable properties on this project and they are considered to be in favour. If these seven properties are not included in the vote, there remains 14 of which 8 are in opposition to this project. Therefore, we recommend this project be withdrawn.

East Side of St. Catherines Street from 22nd Avenue to 23rd Avenue

This project is being withdrawn at this time because one owner is in favour and one opposed. As this is a infill collector sidewalk in a residential area and we do not have a clear majority, we are recommending this project be withdrawn.

Lane south of Yale Street from Slocan Street to Kaslo Street

This project is being withdrawn because a majority of the adjacent owners were not prepared to support this project despite correspondence and a public meeting.

REDUCED IN SCOPE

Court #607, Item #39, Pedestrian Collector Sidewalk
West Side of St. Catherines Street from 23rd Avenue to 24th Avenue

This project is being reduced in scope because a sidewalk already exists between 23rd Avenue and the lane south of 23rd Avenue. Therefore, with the support of the one adjacent owner we are recommending that this project on St. Catherines Street, West Side, from the lane south of 23rd Avenue to 24th Avenue proceed.

Capital Funds

Funds for the City's share of the projects are available from existing Engineering Department Basic Capital Accounts.
