Closure of a Portion of the West Side of Hudson Street, North of 73rd Avenue
RECOMMENDATION
A. THAT Council close, stop-up and convey all that portion of Hudson Street shown hatched on the plan attached as Appendix "A" (the East 7 feet of Lot 1 and Lot 2, both of Block 6, District Lot 318, Plan 1749) subject to the following conditions:
1. The applicant (Glassman Holdings Ltd.) to pay $47,810 plus G.S.T. if applicable, for the 683 square feet of road to be closed, in accordance with the recommendation of the Director of Real Estate Services;
2. The area of closed road is to be consolidated with the abutting Amended Lot 1 (see 215782L) and Amended Lot 2 (see 215781L), both of Block 6, District Lot 318, Plan 1749, so as to form a single parcel generally as shown within the heavy outline on the plan attached hereto as Appendix "A" to the satisfaction of the Director of Legal Services;
3. The applicant to be responsible for any necessary plans, documents and Land Title Office fees;
4. Any agreements are to be to the satisfaction of the Director of Legal Services;
5. No legal right or obligation shall be created and none shall arise hereafter, until the documents are executed by the parties thereto.
COUNCIL POLICY
The authority for closing and disposing of streets and lanes is set out in the Vancouver Charter.
PURPOSE
The purpose of this report is to seek Council authority to close, stop-up and convey a portion of the west side of Hudson Street, north of 73rd Avenue.
BACKGROUND
Portions of Hudson Street, formerly the East 7 Feet of Lot 1 and Lot 2, both of Block 6, District Lot 318, Plan 1749 were established for road purposes in 1949 by document filed 48126 and in 1944 by document filed 38108, respectively. These establishments resulted in an overall width of Hudson Street at this location of 73 feet.
DISCUSSION
At this location of Hudson Street, Engineering Services has determined that a width of 66 feet provides a sufficient road width. The additional 7 foot wide strips of road are therefore surplus to our needs. The applicant is in the process of purchasing the abutting Amended Lot 1 (see 215782L), Block 6, District Lot 318, Plan 1749 at 8889 Hudson Street and Amended Lot 2 (see 215781L), Block 6, District Lot 318, Plan 1749 at 8885 Hudson Street and has made application to acquire these two 7 foot wide strips of road. As such we are recommending to Council that we close, stop-up and convey the 7 foot wide strips of road to the abutting owner, subject to consolidation with said Amended Lot 1 and said Amended Lot 2 to create a single parcel.
The Director of Real Estate Services advises that the $47,810 sale price represents fair market value for the portion of road to be conveyed. The applicant will be responsible for all costs, plans, documents and Land Title Office fees.
CONCLUSION
The General Manager of Engineering Services recommends to Council the closure and conveyance of a portion of the west side of Hudson Street, north of 73rd Avenue (the East 7 feet of Lot 1 and Lot 2, both of Block 6, District Lot 318, Plan 1749) subject to the conditions contained in the Recommendation.
