Roundhouse School Site
RECOMMENDATION
A. THAT Council approve payment to The Board of School Trustees of School District No. 39 (Vancouver) ("VSB") of the amount of $997,007 as the additional costs to be paid by the City for the construction of a 35 stall underground parkade as part of the project to construct a new elementary school on a site owned by the City and legally described as P.I.D. 018-368-964, Lot 214, False Creek, Plan LMP10733 (the "Roundhouse School Site"), as outlined in this report. The source of funds is to be the Parking Sites Reserve.
B. THAT Council authorize entering into a temporary licence for the construction of the school and the underground parkade; an agreement with the VSB on the terms of tenure of the VSB at the Roundhouse School Site and the operation and maintenance of the underground parkade; and any other related agreements the Director of Legal Services and the City Manager deem necessary.
POLICY
Parking Sites Reserve funds are to be used to build, acquire or improve off-street City parking facilities.
On April 28, 2000, Council approved that Pacific Place Holdings Ltd. be discharged from their obligation to cover the additional parking costs at the Roundhouse School Site.
PURPOSE
This report asks Council to approve the City's portion of funding for the construction of 35 stall underground parkade at the Roundhouse School site. This report also seeks Council authority to enter into legal agreements with the VSB on the arrangement for the construction of the school and the underground parkade, the operation and maintenance of the underground parkade and form of tenure of the VSB on this site.
BACKGROUND
In 1992, as part of the rezoning for the Roundhouse Neighbourhood, the applicant was to provide for a daycare and a school. In 1996 Council approved an arrangement for the Roundhouse School and daycare to be housed in a combined facility. The daycare was built and has been open since 1998.
As part of the settlement of property tax appeals on Concord Pacific Place in April 2000, the City agreed to assume the additional costs for constructing the underground parkade at the proposed school site. The additional costs are defined as the difference in cost between a surface lot for the school and the proposed underground parkade, as the school is on a small site compared with other schools. The VSB will be constructing a school and a 35 stall underground parkade on this site, to be operational in September 2003.
DISCUSSION
Staff have negotiated an agreement with the VSB to cost share with the City on the construction of the parking. The cost sharing arrangement is as follows:
City cost = total parkade cost less (surface parking lot cost plus school foundation cost)
Where:
· City cost is the amount to be paid for by the City.
· Total parkade cost is the estimate of the total cost to design and construct the parking structure.
· Surface parking lot cost is the estimate of the cost to design and construct a hypothetical 26 stall surface parking lot to City standards.
· School foundation cost is the estimate of the cost to design and construct a hypothetical foundation of the school if it were free standing (slab on grade), including geotechnical requirements.
The total cost to construct the 35 parking stalls, as estimated by the Education Ministry Quantity Surveyor, would be $1,010,312. Design and consulting fees would be a further $124,393. The City's share of these costs would be $997,007. City staff have reviewed the estimates and concur with the estimated costs. This payment to the VSB will be in full satisfaction of the City's obligation to pay any additional costs for construction of the parkade.This site is covered under the Provincial Soils Agreement with Concord.
Operation of Parkade
The parkade will provide 26 parking stalls for the school staff and 9 stalls for the daycare. Outside of school and daycare hours, the City may use the parkade for public parking. The operation and maintenance costs of the parkade will be split on a pro-rated basis (i.e. number of stalls used, hours occupied during the year etc.) between the daycare, the VSB and the City. Revenue from the public use of the parkade will be used to offset the parkade costs.
VSB Tenure at the Site
The City will be providing a temporary site licence to the VSB for the duration of the construction of the school and parkade. Prior to occupancy, the City and the VSB will be entering into a permanent legal relationship that will define the tenure of the VSB on the site and also detail the operation and maintenance of the parkade. This may require a further report to Council.
The legal relationship has not yet been finalized, but may take the form of one of the following:
· The building will be stratified into one strata lot for each of the daycare, school and parkade. The City will transfer to the VSB the fee simple interest in the school strata lot.
· The City will lease to the VSB the school, being a volumetric lease of the school, excluding the daycare and the parkade. The City will grant an easement to the VSB to use the unimproved lands.
· the City will grant the VSB a permanent licence of both the school and the unimproved lands.FINANCIAL IMPLICATIONS
The City's share of the parkade costs are $997,007. However, it is expected that the costs will be reduced over time through the operation of the parkade on a commercial basis during non-school hours.
CONCLUSION
Staff have negotiated with the VSB to cost share on the construction of a 35 stall underground parkade at the proposed Roundhouse School Site. The City and VSB are to enter into legal agreements to define the tenure of the VSB on the site and to finalize the parkade operating arrangements. Staff recommend that the funding for the City's share of the parkade construction costs come from the Parking Sites Reserve.
