A Regular Meeting of the Standing Committee of Council on Planning and Environment was held on Thursday, March 7, 2002, at 2:00 p.m., in Committee Room No. 1, Third Floor, City Hall.

RECOMMENDATION

1. Warning to Prospective Purchasers of 4555 James Street (File 2701)

The Committee had before it an Administrative Report dated February 7, 2002, in which the City Building Inspector recommended a 336D notice be filed against the title to the property at 4555 James Street to warn any prospective purchasers that there are violations of the Zoning and Development and Vancouver Building By-laws related to this building. It wasalso recommended the Director of Legal Services be authorized to take legal action if, in her opinion, it is appropriate to do so. The General Manager of Community Services recommended approval of the foregoing.

Peter Sweeney, Manager, Building Inspection, reviewed the report and noted that the building had recently been sold, however the land titles had not been transferred as of this morning.

THAT the Committee recommend to Council

A. THAT the City Clerk be directed to file a 336D Notice against the title to the property at 4555 James Street (Lot 54, Blocks 1 to 3 and 8, District Lot 633, Plan 1452) in order to warn prospective purchasers that there are contraventions of the Zoning and Development and Vancouver Building By-laws related to this building.

B. THAT the Director of Legal Services is hereby authorized, in her discretion, to commence a legal action or proceeding in relation to the premises located at 4555 James Street and may, in her discretion, seek injunctive relief in that action or proceeding, in order to bring this building into compliance with City By-laws.

2. Warning to Prospective Purchasers of 6423-6425 Main Street (File 2701)

The Committee had before it an Administrative Report dated February 8, 2002, in which the City Building Inspector recommended a 336D Notice be filed against the title to the property at 6423-6425 Main Street to warn any prospective purchasers that there are violations of the Zoning and Development and Building By-laws in relation to this building. It was recommended the Director of Legal Services be authorized to commence legal action, at her discretion. The General Manager of Community Services recommended approval of the foregoing.

Peter Sweeney, Manager, Building Inspection, with the aid of photographs, reviewed the report, and responded to a question concerning unapproved additions to the building.

THAT the Committee recommend to Council

A. THAT the City Clerk be directed to file a 336D Notice against the title to the property at 6423 - 6425 Main Street (Lot 3, Block 7, District Lot 648, Plan 1748) in order to warn prospective purchasers that there are contraventions of the Zoning and Development and Vancouver Building By-laws related to this building.

B. THAT the Director of Legal Services is hereby authorized, in her discretion, to commence a legal action or proceeding in relation to the premises located at 6423 - 6425 Main Street and may, in her discretion, seek injunctive relief in that action or proceeding, in order to bring this building into compliance with City By-laws.

3. Demolition of Dangerous/Nuisance Building at 2817 Clark Drive (File 2701)

The Committee had before it an Administrative Report dated February 18, 2002, in which the City Building Inspector recommended the building at 2817 Clark Drive, which is in violation of the Vancouver Building, Standards of Maintenance and Untidy Premises By-laws, be declared a nuisance and dangerous to public safety and the property owner be ordered to demolish the building and provide a chain link fence around the site to prevent access and dumping. It was also recommended a 336D Notice be filed against the title to the property in order to warn prospective purchasers of the by-law violations and of the demolition order. The General Manager of Community Services recommended approval of the foregoing.

Peter Sweeney, Manager, Building Inspection, with the aid of photographs, reviewed the condition of the subject property, provided a rationale for the report recommendations, and responded to a question concerning the expected timeline for the work to be carried out.

THAT the Committee recommend to Council

A. THAT Council declare that the building and site at 2817 Clark Drive (Lot B, except the East 7 feet as shown on Plan 4094, Now Road, of Lots 16 and 17, Block 172, District Lot 264A, Plans 1693 and 1771, PID 010-069-313) are a nuisance and dangerous to public safety pursuant to Section 324A of the Vancouver Charter.

B. THAT Council approve the Resolution attached to the Administrative Report dated February 18, 2002, entitled "Demolition of Dangerous/Nuisance Building at 2817 Clark Drive" and order the Registered owner of the property to demolish the building and remove the resulting demolition debris and discarded materials from the site and provide a chain-link fence around the perimeter of the site, within 14 days of a copy of the resolution being served pursuant to Section 324A of the Vancouver Charter.

C. THAT in the event of the failure of the owner to comply with the order of Council, Council further orders and hereby authorizes the City Building Inspector to have the work noted in Recommendation B above, carried out at the expense of the owner.

D. THAT the City Clerk be directed to file a 336D Notice against the Certificate of Title to the property at 2817 Clark Drive in order to warn prospective purchasers that there are violations of the Vancouver Building, Standards of Maintenance and Untidy Premises By-laws related to this property and that there is an order of Council against the property.

4. Grandview and Skeena Intersection Safety Improvements (File 5761)

At its meeting on March 5, 2002, the Standing Committee on Transportation and Traffic, due to time constraints, referred this matter to the March 7, 2002, meeting of the Standing Committee on Planning and Environment.

Accordingly, the Committee had before it this day an Administrative Report dated February 12, 2002, in which the General Manager of Engineering Services, in consultation with the Director of City Plans, recommended new traffic signal and roadway geometric changes at the Grandview and Skeena intersection, and a follow-up local traffic monitoring process for the neighbourhood to the South.

Rod Malkin, Assistant Transportation Engineer, with the aid of graphics, explained how the intersection functions, and reviewed the recommended safety improvements put forth in the report.

Mr. Malkin, along with Brent MacGregor, Deputy City Manager, and Wayne Pledger, Strategic Transportation Planning Engineer, responded to questions concerning whether there was a mechanism by which cost-sharing for part of the project could be obtained from the owner or operator of the CostCo site. Mr. Malkin and Mr. Pledger also responded to questions concerning alternative options for accommodating left turns.

THAT the Committee recommend to Council

THAT left turns be prohibited at the corner of Skeena and Grandview Highway until such time as a cost-sharing agreement has been reached with the property owners for the property on which the CostCo store sits to share the cost of the installation of the left turn bay.

A. THAT safety improvements including a traffic/pedestrian signal, left turn bays and lowering of the roadway at the intersection of Grandview Highway and Skeena Street as described in the Administrative Report dated February 12, 2002, entitled "Grandview and Skeena Intersection Safety Improvements" be approved, at a total cost of $1,150,000, with funding provided as follows: TransLink $400,000, and $750,000 from the Streets Basic Capital Unappropriated Account #30003215 - Grandview and Skeena.

B. THAT staff monitor traffic volumes on local streets in the neighbourhood south of the intersection of Grandview Highway and Skeena Street, and resurvey the neighbourhood regarding the selected traffic management for the intersection, and report back if necessary.
