RECOMMENDATION

THAT Mr. Dave Rudberg, General Manager of Engineering Services, be appointed as Deputy Approving Officer for the period of July 22^nd to August 2, 2002.

The City Manager RECOMMENDS approval of the foregoing.

COUNCIL POLICY

Under Section 77 of the Land Title Act, Council must appoint an Approving Officer to carry out the duties pertaining to subdivision as governed by the Act (and subject to the provisions of the City's Subdivision By-law). Council has also appointed a Deputy Approving Officer to function in the absence of the Approving Officer.

Pursuant to the Strata Property Act, Council has delegated to the Approving Officer its approving authority for specified applications involving conversion of previously occupied buildings.

DISCUSSION

Presently, Mr. Rick Scobie, Director of Development Services, is the Approving Officer for the City and Mr. Tom Timm, Deputy City Engineer, is the Deputy Approving Officer. In scheduling vacations and other periods of absence, Mr. Scobie and Mr. Timm have previously managed to avoid being away concurrently, noting that Mr. Timm must also schedule his affairs in collaboration with the General Manager of Engineering Services, and Mr. Scobie likewise with the Assistant Director of Development Services.

This year, both Mr. Scobie and Mr. Timm will unavoidably both be absent during the last two weeks of July. In order to maintain customer service it is necessary for Council to appoint a Deputy Approving Officer for this period.

When Mr. Brent MacGregor, Deputy City Manager, was previously the Deputy City Engineer he was also appointed by Council as the Deputy Approving Officer. However, his current position could create the potential for a conflict of interest if he were to again be appointed as Deputy Approving Officer. The Approving Officer has approached Mr. Dave Rudberg, General Manager of Engineering Services, and he has agreed to perform these duties for this two-week period, should he be appointed by Council. Consequently, and in consideration of the various engineering matters commonly involved in the consideration of site subdivisions, the Approving Officer recommends that Mr. Rudberg be appointed as Deputy Approving Officer for the period July 22^nd to August 2, 2002, with Mr. Timm resuming this role on August 5^th.
