SUBJECT: Local Improvements by Petition - December 4, 2001

RECOMMENDATION

COUNCIL POLICY

Policies governing the Local Improvement process are set out in the Vancouver Charter and Local Improvements Procedure by-law.

PURPOSE

A Court of Revision is scheduled for December 4, 2001 at 7:30 p.m. to review a number of petition and initiative projects. This is the "First and Second Step" report for the petition projects. The report for initiative projects was approved by Council on October 2, 2001. The purpose of this report is to begin the formal Local Improvement process by advancing the petition projects to the Court of Revision and to report on the financial arrangements for the projects. Approval of this report does not commit Council to undertake the projects.

First Step
As required by the Local Improvement Procedure By-law, projects for:

shown on the attached schedule (Appendix I) are advanced to Council by Petition for review at a Court of Revision which will be held at 7:30 p.m. Tuesday, December 4, 2001.

Request for the deletion of Street Trees from Project Number 15, Pavement & Curbs, Local Residential

In 1991 Council approved a motion recommending that street tree planting be included in all residential and higher zoned street pavement and curb local improvements where possible. At its meeting of July 27, 1993, Council approved a mechanism for considering petitions with signatures from at least two-thirds of the property owners representing at least one-half of the actual property value supporting paving without tree planting.

A petition has been received for the installation of new pavement and curbs on Manitoba Street from 20th Avenue to 21st Avenue. All of the three property owners who properly signed the petition form indicated an opposition to tree planting. The Tax Department has reviewed the petition and advises the necessary two-thirds majority representing at least one-half of the actual property value has been acquired (3 required out of 4).

Recommendation "C" allows Council to decide on proceeding with this project.

FINANCIAL IMPLICATIONS

Local Improvements
Local Improvements is estimated at $1.78 million. The City's share is $0.96 million funded as follows:.
- $0.94 million for the City's share is available from existing Engineering Department Basic Capital Accounts as itemized in Appendix II
- $0.02 million is subject to the approval of the 2002 Streets Basic Capital Budget

Second Step

The Director of Finance reports as follows:

In accordance with the Local Improvements Procedure By-Law, I am submitting the attached City Engineer's Report. The estimated cost of these Local Improvement projects is $1,787,623. The Property owners share of these projects is $823,669. The City's share is $963,954. I have to report that the necessary financial arrangements can be made to carry out this work subject to approval of the 2002 Streets Basic Capital Budget.

The estimated costs provide for necessary incidental work. The cost of the property owner's share of the above noted projects, and interest, is repayable over 15 years, except for lane lighting which is repayable over five years and Street Lighting which is repayable over 10 years.
