Proposed Closure of a Portion of the East Side of Kerr Street, South of 43rd Avenue

 

RECOMMENDATION

COUNCIL POLICY

The authority for closing and disposing of streets and lanes is set out in the Vancouver Charter.

PURPOSE

The purpose of this report is to seek Council authority to close, stop-up and convey to the abutting owners a portion of the east side of Kerr Street south of 43rd Avenue.

BACKGROUND

A portion of Kerr Street, formerly the West 33 Feet of Lot 4, North West 1/4 of Block 17, District Lot 50, Plan 3316 was established for road purposes in 1943 by document filed 36559. This establishment resulted in an overall width of Kerr Street at this location of approximately 83.5 feet.

DISCUSSION

The owner of the abutting Remainder of Lot 4 has made application, subject to purchase price and subdivision, to acquire the surplus portion of Kerr Street. At this location of Kerr Street, Engineering Services has determined that a width of 66 feet provides a sufficient road corridor. The remaining strip of road approximately 5.3 metres (17.4 feet) wide is therefore surplus to our needs.

The Director of Real Estate Services advises that the $26,000 sale price represents fair market value for the portion of Kerr Street to be conveyed. The applicant will be responsible for all costs, plans, documents and Land Title Office fees required to subdivide and dedicate back the portion of the West 33 feet of Lot 4 still required for road purposes.

Since 1984, Council has supported four similar proposals on adjacent properties to the south of this site.

CONCLUSION

At this location of Kerr Street we have determined that a 66 feet road width is adequate for our needs, therefore the General Manager of Engineering Services recommends approval of the Recommendation.
