COUNCIL POLICY

Article 1A.7.5.1 of the Building By-law prohibits the Chief Building Official from granting more than one extension to a Building Permit. Any further extensions can only be approved by Council.

DISCUSSION

Building Permit No. BU414049 was issued on January 27, 2000 for the construction of a new 18-storey office/retail building with five levels of underground parking/loading at 1177 West Pender Street. The permit was extended once by the Chief Building Official and a second time by Council on January 9, 2000 and is due to expire on July 27, 2001. As the permit was issued one day before the Vancouver Development Cost Levy By-law came intoeffect, a Development Cost Levy was not paid. The levy for this project would be $377,035.00.

If the Development Cost Levy were to be paid, staff would be recommending approval of this extension.

If this permit expires, the applicant may apply for a partial refund of Building Permit fees. A new application would be required and would be subject to all required permit fees plus the Development Cost Levy.

Our inspection services confirm that there is an existing building on the site which is still occupied.

There has been no change to the zoning for the property (DD - Downtown District). Related Development Permit No. DE403824 is valid as long as this Building Permit is active. The Planning Department has no objection to an extension provided the Development Cost Levy is paid, and advises that the Director of Planning may consider renewal of the Development Permit up to the second anniversary of its issuance (January 27, 2002)
