SUBJECT: Local Improvements by Initiative - September 11, 2001 - First and Second Step Report
RECOMMENDATION
A. THAT the projects listed in Appendix I be advanced as Local Improvements on the Initiative and brought before a Court of Revision on September 11, 2001.
B. THAT the reports of the City Engineer and Director of Finance be adopted together with details of the Second Step Report as summarized in Appendix II, and Council declare it is desirable that the projects set out in Appendix I of this report be undertaken and deems that each will specially benefit the real property abutting it. (Requires two-thirds approval of those present).
COUNCIL POLICY
Policies governing the Local Improvement process are set out in the Vancouver Charter and Local Improvements Procedure by-law.
PURPOSE
A Court of Revision is scheduled for September 11, 2001 at 7:30 p.m. to review these initiative projects. The purpose of this report is to begin the formal Local Improvement process by advancing the initiative projects to the Court of Revision and reporting on the financial arrangements for the projects. Approval of this report does not commit Council to undertake the projects.
First Step
As required by the Local Improvement Procedure By-law, projects for the following categories and detailed on the attached schedule (Appendix I), are advanced to Council by Initiative for review at a Court of Revision, which will be held at 7:30 p.m., Tuesday, September 11, 2001.

Funds for the City's share of the projects are available from existing Engineering Department Basic Capital Accounts.
Second Step
The Director of Finance reports as follows:
In accordance with the Local Improvements Procedure By-law, I am submitting the attached City Engineer's report. The estimated cost of these projects is $232,069. The property owners' share of the projects is $63,484. The City's share is $168,585. I have to report that the necessary financial arrangements can be made to carry out this work.

INITIATIVE PROJECTS - SCHEDULE #603
I. PAVEMENT & CURBS, HIGHER ZONED
1. 2ND Avenue - S/S - from Brunswick Street to Prince Edward Avenue
This project was withdrawn at the June 12, 2001 Court of Revision because the single owner adjacent the project did not return a ballot or respond to our calls. We had verbal confirmation but requested written confirmation prior to the Court of Revision. This owner has since called, reinforcing his support and desires to see the work done this year. He claims he did not receive the ballot and hopes that the project can still proceed. The approval of this project would complement the curbing and paving work scheduled for the north side of the street.II. PAVEMENT & CURBS, LOCAL RESIDENTIAL
2. Carnarvon Street from 28th Avenue to 29th Avenue
This project was withdrawn at the June 12, 2001, Court of Revision because a clear consensus was not received in time from the four affected owners. Three ballots were returned of which two were in favour and one opposed. The remaining owner did not return a ballot or respond to calls prior to the Court of Revision resulting in the project being withdrawn. Subsequently, the owner that did not respond called the following day after the Court of Revision explaining that he was away on vacation and arrived home late the previous evening. The owner supports the proposed project which now has a clear majority, (3 out of 4 owners in favour) and request that we take steps for work to begin this year rather than next year.3. Whyte Avenue from Cypress Street to Chestnut Street
This project was withdrawn at the June 12, 2001 Court of Revision to allow adjacent owners time to consider new information as well as take advantage of a reduction in costs. A reduction is provided from funds set aside to repair damage caused from the installation of a dedicated watermain for firefighting purposes.The owners were balloted to determine if they wish to see the street repaired or to see the street improved with pavement and curbs. Of the 21 affected owners, 16 owners have responded of which 11 owners are in favour of the street improvement project and 5 owners are in favour of having the street repaired. Rather than leave the street in poor condition until next year this project was advanced to the September Court of Revision in order for work to proceed this year.
