Proposed Closure of a Portion of the West Side of Nanaimo Street South of 35th Avenue
RECOMMENDATION
A. THAT all that portion of Nanaimo Street shown hatched on the plan attached as Appendix "A" (on file in City Clerk's Office) (the westerly 17.54 feet) be closed, stopped-up and conveyed to the abutting owners subject to the following conditions:
1. The purchase price to be $ 40,000.00 plus G.S.T. if applicable, for the 1160 square feet of road to be closed, in accordance with the recommendation of the Director of Real Estate Services;
2. The area of closed road is to be subdivided with the abutting Lots C and D both of Lot 2, Block 2, District Lot 394, Plan VAP 23091 to the satisfaction of the Director of Legal Services and the Approving Officer;
3. The abutting owners enter into an agreement of support for the lane west of the abutting parcels to the satisfaction of the Director of Legal Services and the General Manager of Engineering Services;
4. The abutting owner to be responsible for any necessary plans, documents and Land Title Office fees;
5. Any agreements are to be to the satisfaction of the Director of Legal Services;
6. No legal right or obligation shall be created and none shall arisehereafter,
If Council approves this report, the Formal Resolution to close this portion of Nanaimo Street will be before Council later this day for approval.
COUNCIL POLICY
The authority for closing and disposing of streets and lanes is set out in the Vancouver Charter.
PURPOSE
The purpose of this report is to seek Council authority to close, stop-up and convey to the abutting owners a portion of the west side of Nanaimo Street south of 35th Avenue.
BACKGROUND
A portion of Nanaimo Street, formerly the East 27 Feet of Lots 25 and 26, Block 2, District Lot 394, Plan 2050 was established for road purposes in 1946 by document filed 41703. This establishment resulted in an overall width of Nanaimo Street at this location of 93 feet.
DISCUSSIONAt this location of Nanaimo Street, Engineering Services has determined that a width of 75.46 feet (23 metres) provides a sufficient road corridor. The remaining 17.54 foot wide strip of road is therefore surplus to our needs. In July 1996, Council supported a similar proposal on the two adjacent properties to the south of this site.
CONCLUSION
The General Manager of Engineering Services recommends approval of the Recommendations.
