RECOMMENDATION

COUNCIL POLICY

PURPOSE

Projects by Petition and on the Initiative Principle have been advanced under the provisions of the Local Improvements Procedure By-law and will come before a Court of Revision on June 12, 2001.

Jervis Street from Robson Street to Alberni Street

This project is being withdrawn at this time to clarify and resolve whether airspace parcels that are stratified are deemed assessable or not.

2nd Avenue, South Side, from Brunswick Street to Prince Edward Street
5th Avenue, South Side, from Prince Edward Street to Guelph Street

This project is being reduced in scope from a two block project to a single block project. Two residential properties on one block objected to the project, however, the remaining owner on the other block supported the project. Therefore, we are recommending that the project be reduced in scope to 2nd Avenue, South Side, from Brunswick Street to Prince Edward Street.

Whyte Avenue from Cypress Street to Chestnut Street

This project is being withdrawn at this time because of concerns raised by the adjacent owners. They are concerned about the improvement of the street as well as the repair of the street after the Waterworks Branch complete their new post-disaster firefighting water main. Some owners feel they would be paying for repair of the street due to water main construction. Normally after any utility work is done, funds are acquired from the appropriate Branch. These funds can be credited toward the project thus reducing the property owner cost of the street improvement. At this time work for the water main has not yet started and it is difficult to determine any credits until the extent of damage is ascertained. Therefore, we recommend this project be withdrawn at this time.

Funds for the City's share of the projects are available from existing Engineering Department Basic Capital Accounts.
