A Regular Meeting of the Council of the City of Vancouver was held on Tuesday, June 5, 2001, at 2:00 p.m., in the Council Chamber, Third Floor, City Hall.

(e) the acquisition, disposition or expropriation of land or improvements, if the Council considers that disclosure might reasonably be expected to harm the interests of the city.

REQUEST TO SPEAK
Council had before it a letter, dated June 4, 2001, from CAW Local 111 requesting to speak on the issue of the transit strike.
The Deputy Mayor advised the issue is beyond Council's jurisdiction and that it is not Council's practice to hear speakers involved in contract negotiations.
Don MacLeod, President of CAW Local 111, commenced speaking, but was not given the floor. The Deputy Mayor called for order but the speaker continued to speak.

A Vancouver Perspective
April 18, 2001 (File: 3253)Rick Gates, Social Planner, presented an update of the Federation of Canadian Municipalities Quality of Life project and an analysis of the first two reports from the project, as they relate to Vancouver. Mr. Gates also provided a summary of the significant differences between Vancouver and other cities in Canada, and with Jeff Brooks, Director of Social Planning, responded to questions on the findings of the 2001 report.

A. THAT Council close, stop-up and convey to the owner of the abutting Lot 237 False Creek Plan LMP 13010 the 61.0 square metre portion of Beatty Street and Smithe Street and the 121.1 square metre portion of Smithe Street and Expo Boulevard each as shown in bold outline on the plan attached asAppendix A to the Administrative Report, dated April 30, 2001, subject to the following terms and conditions:
1. The dedication to the City as road of the 77.1 square metre portion of Lot 237 adjacent to Smithe Street and the 203 square metre portion of Lot 237 adjacent to Expo Boulevard each as shown hatched on the plan attached as Appendix "A" to the Report, such dedications to the satisfaction of the Approving Officer;
2. The consolidation of the portions of road to be closed and stopped-up with the balance of Lot 237 so as to create a single parcel the same as shown in heavy outline on the plan attached as Appendix "B" to the Administrative Report dated April 30, 2001;
3. The conveyance of the closed road to occur for a nominal sum of $10.00;
4. Registration of a temporary right-of-way or other arrangements to the satisfaction of the City Engineer over the portions of the closed road until such time as the existing roads and services are relocated;
5. Registration of 2.0 metre x 2.0 metre (surface) pedestrian corner-cut rights-of-way at the intersection of Smithe Street and Beatty Street and Smithe Street and Expo Boulevard, the same as generally shown hatched on the plan attached as Appendix "B", to the Administrative Report, dated April 30, 2001;
6. Registration of an agreement to the satisfaction of the City Engineer and the Director of Legal Services for provision and maintenance of a bulkhead to ensure continued support of Beatty Street adjacent to the site;
7. A review of all registered and unregistered charges to determine if amendments, modifications, deletions or replacements are required to any charge; and
8. All such other things as may be required or deemed necessary by the City Engineer, City Manager and the Director of Legal Services to complete the land exchange.
B. THAT no legal rights shall arise and no consents, or permissions, are granted hereby and none shall arise or be granted hereafter unless and until all contemplated legal documentation has been executed, delivered by all parties,and registered in the Land Title Office where applicable.
C. THAT once the form of all legal documentation and plans has been approved by the City Engineer, and Director of Legal Services that the Director of Legal Services be authorized to execute and deliver such documentation and plans on behalf of the City.

A. THAT Council award contracts for telecommunications goods and services as follows:
(i) To Sprint Canada Inc. for provision of communications equipment and installation services and Synchronous Digital Subscriber Line (SDSL) service to designated City locations, at an estimated maximum cost of $482,000 one-time and $282,000 annually (plus applicable taxes), based on a five-year contract;
(ii) To Telus Advanced Communications for provision of fibre optic "Municipal Link" service to designated City locations, at an estimated maximum cost of $25,000 one-time and $55,000 annually (plus applicable taxes), based on a five-year contract.
subject to establishment of master contracts satisfactory to the Director of Information Technology, the Director of Legal Services, and the Manager of Materials Management; source of funding to be provided from a combination of operating savings, current operating budget funding and the Information Technology Long Term Financing Plan as outlined in the Administrative Report, dated May 1, 2001.

4. Proposed Lease of Portions of Kent Avenue South, Dudley Street, Cromwell Street, Kinross Street and Hartley Street

A. THAT Council close, stop-up and lease to the abutting owners all those portions of:
(a) Dudley Street south of Kent Avenue South and Kent Avenue South from the westerly limit of Hartley Street to the westerly limit of Boundary Road;
(b) Hartley Street and Kinross Street lying between the northerly shore of the north arm of Fraser River and a line drawn parallel to and 66 feet perpendicularly distant southerly from the centre line of the right of way of the Vancouver and Lulu Island Railway; and
(c) Easterly 66 feet of that portion of Cromwell Street lying to the south of the Vancouver and Lulu Island Railway right-of-way;
the same as each shown in heavy outline on the plan attached as Appendix "A" (the "Road Portions") to the Administrative Report, dated May 15, 2001, subject to the following conditions:
(1) The term of the lease to be five (5) years commencing February 1, 2001 subject to a one (1) year notice of cancellation;
(2) The rental to be $200,000.00 per annum inclusive of property taxes as if levied plus GST and PST if applicable from February 1, 2001 to July 31, 2003 and $225,000.00 per annum inclusive of property taxes as if levied plus GST and PST if applicable from August 1, 2003 to January 31, 2006;
(3) The uses to be limited to:
a. for Kent Avenue South railroad and vehicular access;
b. for Dudley Street parking, sawmilling and manufacturing;
c. for Hartley Street and Kinross Street sawmilling; and
d. for Cromwell Street, access, lumber storage, existing buildings, fixtures and improvements thereon as required by the tenant for conducting its business;(4) There are to be no buildings or structures constructed on the lease area,although those presently in place can remain, subject to the terms of the lease;
(5) The lessee is to maintain the lease area, including responsibility for drainage, in a manner satisfactory to the City Engineer;
(6) Upon expiry or termination of the lease, the lessee is to be responsible for restoration of the lease area to the satisfaction of the City Engineer;
(7) The City, public utility companies, and the G.V.R.D. are to have the right of entry, at any time, to the lease area for the purpose of installing, maintaining, and repairing public utilities;
(8) The lease to contain a provision restricting the stacking of heavy loads over the lease area;
(9) The lessee to assume full responsibility for liabilities, loss and damages from their occupancy or use of the lease area, and to insure the proposed lease area with a comprehensive general liability and property damage insurance policy to the satisfaction of the Director of Real Estate Services and the Director of Risk Management; and
(10) The lease agreement to be to the satisfaction of the Director of Legal Services, the Director of Real Estate Services, and the City Engineer and may contain other terms and conditions to the satisfaction of the Director of Legal Services, Director of Real Estate Services, and the City Engineer.

1. Resolution of Transit Strike (File: 5551)

WHEREAS the Lower Mainland public transit strike is now in its third month;
AND WHEREAS seniors, students, low-income people, the disabled and others dependent on public transit have had their lives severely disrupted by the strike, reducing their quality of life;
AND WHEREAS many small businesses, cultural organizations and non-profit agencies are experiencing a reduction in activity, negatively affecting the economic, artistic and social fabric of our region;
AND WHEREAS striking transit workers and their families have had to cope with severe reduction in their household incomes;
AND WHEREAS the lack of public transit has put more vehicles on our roads - in direct contradiction of the Livable Region Strategic Plan - contributing to greater traffic congestion and poorer air quality in the region;
AND WHEREAS two issues impede the settlement of the strike - the hiring of part-time workers and contracting out;
THEREFORE BE IT RESOLVED THAT Vancouver City Council, to end the strike immediately, urge TransLink, its contractor Coast Mountain Bus Company and the transit unions to remove the issues of part-time workers and contracting out from the negotiating table, and establish a joint labour-management committee to negotiate successful resolution of these two disputed items.

ENQUIRIES AND OTHER MATTERS
1. Forum on Pedestrian Safety (File: 5701)
Councillor Louis provided copies of a report on a public forum on Pedestrian Safety held February 28, 2001. He requested staff to provide information on the City's ability to implement the forum recommendations.
The Deputy City Manager agreed to provide a memorandum with the staff response.
2. Main and Terminal - Community Protection Concerns (File: 3501)
Councillor Price expressed concerns with conditions around the Main and Terminal area, which is one of the main entrances into the City of Vancouver. He listed a number of conditions he felt should be addressed, including: graffiti, panhandling, litter, dealing in stolen goods, unswept sidewalks, and police inaction.
The Deputy City Manager agreed to ask staff to address the concerns.

4. Federation of Canadian Municipalities Conference (File: 3253)
Councillor McCormick reported on her attendance at the FCM Conference, held May 25 to 28, 2001 in Banff, Alberta. Also attending were the Mayor and Councillors Bass, Don Lee and Puil. Amongst the many sessions offered at the Conference was one on the FCM's municipal drug strategy. Councillor McCormick advised the strategy includes running five pilot projects across Canada on the municipal drug strategy and enquired whether Vancouver was one of the pilot projects.
The Deputy City Manager agreed to provide the requested information.
5. FCM Award - Don Bellamy (File: 1051)
Councillor Bass advised former Councillor Don Bellamy was awarded the Federation of Canadian Municipalities "Role of Honour" in recognition of distinguished service to municipalities and the FCM.
Council agreed to send a letter of congratulations to Mr. Bellamy.
The Council adjourned at 5:45 p.m.
