Proposed Lease of a Portion of Unnamed City Street East of Station Street, North from Industrial Avenue

 

RECOMMENDATION

COUNCIL POLICY

The authority for closing and disposing of streets and lanes is set out in the Vancouver Charter.

On March 6, 2001 Council approved the acquisition of the north-south 66 foot wide road dedication. The source of funds for the acquisition was the Land Purchase Fund.

PURPOSE

The purpose of this report is to seek Council authority to close, stop-up and lease to the owner of the abutting easterly Lot B all that portion of the as yet unnamed City street, east of Station Street, north from Industrial Avenue shown hatched on Appendix "A".

BACKGROUND

The subject site at the north-east corner of Station Street and Industrial Avenue lies within the False Creek Flats, an area of the City where significant subdivision and development planning work is underway. While working on the proposed "CN Lands" subdivision to the north of the site, staff determined the acquisition of a 66 foot wide road dedication, north from Industrial Avenue represented a strategic purchase.

On March 6, 2001 Council approved the recommendations contained in the February 27, 2001 Administrative Report from the Director of Real Estate Services. This included:

a. A purchase of the 66 foot wide road dedication in a north-south direction;

b. A purchase of a 10 foot wide dedication for widening of Industrial Avenue;

c. Acquisition of a temporary right-of-way to contain existing sewers on the east side of proposed Lot B; and further

d. Council instructed the General Manager of Engineering Services in consultation with the Director of Real Estate Services to report back on terms and conditions to close, stop-up and lease all that portion of road shown hatched on the plan attached as Appendix "B" to the Administrative Report dated February 27, 2001 to the owner of proposed easterly Lot B.

DISCUSSION

The acquisition of the said dedications and right-of-way is presently underway. Legal surveys are completed and the subdivision plan has been approved by the Approving Officer.
Once the survey plans are registered, the 66 foot wide north-south dedication is intended to be leased to the owner of the easterly abutting Lot B as per Recommendation C of Council's March 6, 2001 approval.

The Director of Real Estate Services has negotiated a two (2) year lease for $29,700.00 per year, inclusive of all real property taxes for the purpose of storage of automobiles by the current tenant on Lot B.

As the 66 foot wide north-south dedication is not required for road purposes at this time, the lease is an appropriate use. We will maintain the right to install utilities as required.

CONCLUSION

The General Manager of Engineering Services in consultation with the Director of Real Estate Services recommends approval of Recommendations A and B so as to close, stop-up and lease to the owner of the abutting Lot B all that portion of the as yet unnamed City street, east of Station Street, north from Industrial Avenue shown hatched on the plan attached as Appendix "A" (on file in City Clerk's Office).
