SUBJECT: Local Improvements by Petition - June 12, 2001
First and Second Step Report and Approval of a City Funded Project
RECOMMENDATION
A. THAT petition projects listed in Appendix I be brought before a Court of Revision on June 12, 2001.
B. THAT the reports of the City Engineer and Director of Finance be adopted together with details of the Second Step Report as summarized in Appendix II.
C. THAT project Numbered 37, for pavement and curbs on Skeena Street from 25th Avenue to 26th Avenue, be brought before a Court of Revision on June 12, 2001, but that tree planting be excluded from this project.
D. THAT sidewalk projects Numbered 79-80 inclusive, as described in Appendix I, be designated as "pedestrian collector routes" so that the abutting residential property owners' rates are reduced by the required 25%.
E. THAT Hawks Avenue from Prior Street to Malkin Avenue be curbed and paved to a width of 12 metres, with funding of $285,000 provided from Streets Basic Capital Account Group SCA5B-UNAP following approval of the 2001 Streets Basic Capital Budget.
COUNCIL POLICY
Policies governing the Local Improvement process are set out in the Vancouver Charter and Local Improvements Procedure by-law.
PURPOSE
A Court of Revision is scheduled for June 12, 2001 at 7:30 p.m. to review a number of petition and initiative projects. This is the "First and Second Step" report for the petition projects. The report for initiative projects was approved by Council on April 10, 2001. The purpose of this report is to begin the formal Local Improvement process by advancing the petition projects to the Court of Revision and to report on the financial arrangements for the projects. Approval of this report does not commit Council to undertake the projects.
Also this report seeks approval to curb and pave Hawks Avenue between Prior Street and Malkin Avenue. Although this project is not subject to the Local Improvement process, it involves construction that is normally covered by this process.

shown on the attached schedule (Appendix I) are advanced to Council by Petition for review at a Court of Revision which will be held at 7:30 p.m. Tuesday, June 12, 2001.
Request for the deletion of Street Trees from Project Number 37, Pavement & Curbs, Local Residential
In 1991 Council approved a motion recommending that street tree planting be included in all residential and higher zoned street pavement and curb local improvements where possible. At its meeting of July 27, 1993, Council approved a mechanism for considering petitions with signatures from at least two-thirds of the property owners representing at least one-half of the actual property value supporting paving without tree planting.
A petition has been received for the installation of new pavement and curbs on Skeena Street between 25th Avenue and 26th Avenue. All of the six property owners who properly signed the petition form indicated an opposition to tree planting. The Tax Department has reviewedthe petition and advises the necessary two-thirds majority representing at least one-half of the actual property value has been acquired (6 required out of 9).
Recommendation "C" allows Council to decide on proceeding with this project.
Curbing and Paving Hawks Avenue from Prior Street to Malkin Avenue
This section of Hawks Avenue has deteriorated significantly, and is becoming increasingly difficult to maintain by normal methods. As there are no assessable properties on either side, this street does not qualify as a Local Improvement project. This street provides access for Fire Department vehicles to their training site, as well as other vehicles destined for the industrial area. Furthermore, Strathcona Park which is adjacent the street, attracts numerous users to the area. Due to the relatively high use of the street and very poor condition, it is recommended that the street be improved at City cost. The estimated required funding of $285,000 can be provided from funds set aside for Higher Zone streets following approval of the 2001 Streets Basic Capital Budget.
Capital Funds
Funds for the City's share of the projects are available from existing Engineering Department Basic Capital Accounts, or are subject to approval of the 2001 Streets Basic Capital Budget.
Second Step
The Director of Finance reports as follows:
In accordance with the Local Improvements Procedure By-Law, I am submitting the attached City Engineer's Report. The estimated cost of these Local Improvement projects is $3,309,159. The Property owners share of these projects is $1,377,125. The City's share is $1,932,034. I have to report that the necessary financial arrangements can be made to carry out this work subject to approval of the 2001 Streets Basic Capital Budget.
