A Regular Meeting of the Standing Committee of Council on Planning and Environment was held on Thursday, April 26, 2001 , at 2:20 p.m., in Committee Room No. 1, Third Floor, City Hall.

ADOPTION OF MINUTES
The Minutes of the Standing Committee on Planning and Environment meeting of Thursday, March 29, 2001, were adopted.
RECOMMENDATION
1. Warning to Prospective Purchasers of 469, 477, 483 and
491 East 10th Avenue File: 2701
At the April 12, 2001 meeting of the Standing Committee on Planning and Environment, Council referred consideration of the Administrative Report dated March 13, 2001, to its next meeting in order to receive additional information from staff.
Peter Sweeney, Manager, Building Inspection Branch, reviewed the report, reiterated staff's position as outlined in the report and responded to questions. He advised the owners, as directed at the April 12, 2001 meeting, had not issued eviction notices nor had they obtained financing. Staff contacted the owners one week after the meeting asking for options to be considered and none were offered.
Lise Guillemette and Wayne Helfrich, Owners, provided a brief history of the properties and their maintenance efforts to date. They acknowledged permits should have been obtained for specific projects. They read a notarized letter advising houses will not be sold for one year from April 26, 2001 and work required by the City will be completed.

A. THAT the City Clerk be directed to file a 336D Notice against the title to the properties at 469, 477, 483 and 491 East 10th Avenue, Lots 10,11,12 & 13, Block 124, District Lot 264A, Plan 1355 & 1771, PIDs 011-895-071, 006-715-095,007-349-068, 003-691-977, in order to warn prospective purchasers that there are contraventions of the Zoning and Development and Vancouver Building By-laws related to these buildings.
B. THAT the Director of Legal Services is hereby authorized, in her discretion, to commence legal action or proceedings in relation to the premises located at 469,477,483 & 491 East 10th Avenue and may, in her discretion, seek injunctive relief in those actions or proceedings, in order to bring these buildings into compliance with City By-laws.

2. Warning to Prospective Purchasers of 3125-27 Glen Drive, 3143-45 Glen Drive and 3165 Glen Drive File: 2701
The Committee had before it an Administrative Report dated March 2, 2001 in which the City Building Inspector recommended approval to file a 336D Notice against the properties at 3125-27, 3143-45 and 3165 Glen Drive to warn prospective purchasers of contraventions of Part 7 (Plumbing Services) of the Vancouver Building By-law related to these buildings. The General Manager of Community Services supported the recommendations.
Carlene Robbins, Manager, By-law Administration Branch, and Bob Postlethwaite, Supervisor, Sewer Separation Branch, reviewed the report and responded to questions.
Kim Tuyet Huynh, Owner, spoke in opposition to the recommendation.
Staff advised that while Ms. Huynh's property complies to the By-law, the 336D Notice would provide her protection in event of sale. It was acknowledged that her situation, while not caused by her, cannot be resolved without compliance by adjoining properties. Staff advised a 336D Notice is the least damaging of notices that can be affixed to the title.

from the Plaza of Nations File: 2614-1
The Committee had before it an Administrative Report dated April 12, 2001, in which the Chief License Inspector recommended Council not endorse an application by 467794 BC Ltd. (The Rage) and 476259 BC Ld. (Yuk Yuk's Comedy Club) to relocate existing cabarets to 974-980 Granville Street. The General Manager of Community Services supported the recommendations.
Guy Gusdal, License Coordinator, reviewed the report and responded to questions.

Speakers' comments included:
· plans to develop Plaza of Nations site include hotel/convention facilities and retention of cabaret facilities
· expressed belief that this is not a true relocation; if relocation is approved, the Plaza of Nations sites would not be permanently closed to two cabarets as Canadian Metropolitan Properties will apply for similar licenses
The following spoke in opposition to the recommendations:

Speakers' comments included:
· working on a month-to-month agreement at Plaza of Nations is detrimental to maintaining a viable business operation
· liquor licenses belong to operators
· reviewed corporate history (including security/policing) and marketing plans

· two potential time-limited properties for Granville Street do not appear to be going ahead; therefore seating capacity limits are not a concern
· there has been no policing problems, can handle line-ups, crowds
· construction of new building would enhance Granville Street
Council requested staff provide a list of venues , including time-limited development permit dates, number of seats for each establishment and available seats on Granville Street on a block by block basis for next report of this nature.

The Committee had before it an Administrative Report dated April 12, 2001, in which the Chief License Inspector recommended Council not endorse an application by KKBL No. 324 Ventures Ltd. for a 65-seat plus 20-seat patio Class `D' Neighbourhood Pub at 957 Granville. Staff further recommended Council adopt a policy to not approve transfers of Council-endorsed liquor licenses between properties and that applications be considered on a site specific basis only. The General Manager of Community Services supported the recommendations.

· based on City mandate for endorsing applications as set out in Provincial Liquor Licensing Act, all criteria have been met
Paul Teichroeb, Chief License Inspector, responded to questions regarding the original application at 950 Granville Street and lack of compliance with time limited development permit dates. He noted other applications were received prior to the application by KKBL No. 324 Ventures Ltd. He also reviewed the original policy guidelines of establishments to be endorsed for Granville Street. The Deputy City Manager reviewed the relevant policy approved by Council on January 30, 2001.
The following spoke in favour of the recommendations and why the Luv-A-Fair application should be next in line:

5. False Creek Flats - CN Lands Subdivision -
Park Conveyance Payment-in-Lieu File: 8203
The Committee had before it a Policy Report dated April 1, 2001, in which the Director of Current Planning in consultation with the General Manager of Engineering Services and Director of Real Estate Services, sought Council approval to accept a payment in lieu of park conveyance regarding the subdivision of Parcel 1, D.L. 2037, Plan LMP 39747 at 300 Terminal Avenue (the CN Rail Yards).
Brent Elliot, Planning Analyst, reviewed the report and responded to questions.

THAT Council authorise a payment in lieu of park conveyance, regarding the subdivision of the Canadian National Railway Company (CN) lands on Terminal Avenue, legally described as Parcel 1, District Lot 2037, Group 1, New Westminster District, Plan LMP 39747.

6. GVRD Liquid Waste Management Plan File: 3753
As a delegation request had been received, Council at its meeting on April 24, 2001, referred the following motion to the Standing Committee on Planning and Environment meeting on April 26, 2001 in order to hear speakers:
WHEREAS on March 28, 2000, Department of Fisheries and Oceans pollution officer Mike Nikl advised the GVRD that "their ( Liquid Waste Management) plan is not compatible with the Fisheries Act," and "the public has already told them (GVRD) they are willing to pay for sewage upgrades";
AND WHEREAS on February 16, 2001, Fisheries and Oceans Regional Director Guy Beaupre advised GVRD Manager Ken Cameron that "It is our view that the (GVRD Liquid Waste Management) Plan currently does not address clearly the need to meet regulatory requirements in a timely fashion";

AND WHEREAS in February 2001, toxicity tests of effluents samples at the Iona and Lions Gate Sewage treatment plants conducted by Environment Canada found that discharges from both violate the Fisheries Act;
AND WHEREAS on March 20, 2001, Environment Canada's Environmental Protection Branch advised the GVRD of the results of toxicity tests at Iona and Lions Gate and warned that the GVRD was not complying with the Fisheries Act;
AND WHEREAS when Council adopted the GVRD Liquid Waste Management Plan on March 15, 2001, Council was not advised of concerns raised by the Department of Fisheries, nor was Council aware of Environment Canada's concerns about effluent discharge from Iona and Lions Gate;
AND WHEREAS GVRD Director and West Vancouver Cllr. Victor Durman, is seeking a legal opinion on GVRD liability if the Liquid Waste Management Plan is in violation of the Fisheries Act;
THEREFORE BE IT RESOLVED that Council invite Environment Canada's BC and Yukon Director General Don Fast, Fisheries and Oceans Canada Regional Director Donna Petrachenko and GVRD Regional Utility Planning Manager Fred Nenninger to advise Council of their concerns about the GVRD Liquid Waste Management Plan.

· Seattle system should be reviewed as an example of good management
Jeff Addis, Sewers and Drainage Engineer, Brent MacGregor, Deputy City Manager, and Tom Timm, Deputy City Engineer, responded to questions reviewing history, sewer overflows, ecological impacts, financial implications, toxicity, and current status.

THAT the final paragraph of the motion, be amended by:
a) adding Jim McCracken, Regional Director, Ministry of Environment, Lands & Parks, Lower Mainland Region, to the list of names in the motion,
b) deleting "Council" after the words "to advise" and inserting "GVS&DD" and,
c) deleting "of their" following "Council" and inserting the words "if they".

WHEREAS on Mar. 28, 2000, Department of Fisheries and Oceans pollution officer Mike Nikl advised the GVRD that "their ( Liquid Waste Management) plan is not compatible with the Fisheries Act," and "the public has already told them (GVRD) they are willing to pay for sewage upgrades";

AND WHEREAS on Feb. 16, 2001, Fisheries and Oceans Regional Director Guy Beaupre advised GVRD Manager Ken Cameron that "It is our view that the (GVRD Liquid Waste Management) Plan currently does not address clearly the need to meet regulatory requirements in a timely fashion";
AND WHEREAS in February 2001, toxicity tests of effluents samples at the Iona and Lions Gate Sewage treatment plants conducted by Environment Canada found that discharges from both violate the Fisheries Act;
AND WHEREAS on March 15, 2001, SPEC president David Cadman advised Council that not amending the Liquid Waste Mangement Plan to upgrade the Iona and Lions Gate plants could violate the Fisheries Act;
AND WHEREAS on March 20, 2001, Environment Canada's Environmental Protection Branch advised the GVRD of the results of toxicity tests at Iona and Lions Gate and warned that the GVRD was not complying with the Fisheries Act;
AND WHEREAS on March 29, 2001, Sierra Legal Defence staff lawyer Tim Howard advised GVRD directors that "By failing to address long-standing problems of the facilities identified above (Iona and Lions Gate), the GVRD/GVS&DD are exposing themselves to potential liability under the Fisheries Act";
AND WHEREAS when Council adopted the GVRD Liquid Waste Management Plan on March 15, 2001, Council was not advised of concerns raised by the Department of Fisheries, nor was Council aware of Environment Canada's concerns about effluent discharge from Iona and Lions Gate;
AND WHEREAS GVRD Director and West Vancouver Cllr. Victor Durman, is seeking a legal opinion on GVRD liability if the Liquid Waste Management Plan is in violation of the Fisheries Act;
AND WHEREAS violations of the Fisheries Act may result in fines of up to $1 million a day;
THEREFORE BE IT RESOLVED that Council request that the GVRD revise the Liquid Waste Management Plan to implement provisions for upgrading the Iona and Lions Gate sewage treatment plants that will enable them to comply with the Canada Fisheries Act.

8. Privatization of GVWD Seymour Filtration Plant File: 3753
As a delegation request had been received, Council at its meeting on April 24, 2001, referred the following motion to the Standing Committee on Planning and Environment meeting on April 26, 2001 in order to hear speakers:
WHEREAS the Greater Vancouver Water District (GVWD) is proposing to enter into a public-private partnership for the design, construction and operation of a new Seymour Water Filtration plant;
AND WHEREAS entry into such a partnership, within the context of existing or proposed international agreements on the trade of goods and services, has serious implications for the public supply and regulation of water resources and services;
AND WHEREAS a 1995 consultant's report to the GVWD concluded that the legal and financial risks and liabilities inherent in such a project would be placed solely upon the public interest within such a partnership;
AND WHEREAS there has been no substantial process to inform the public of this proposed partnership and its potential risks, nor to solicit public opinion on it;
AND WHEREAS North Vancouver City Council will consider a similar motion on April 23, 2001;

THEREFORE BE IT RESOLVED THAT Vancouver City Council request the GVWD to develop and implement a public involvement process prior to any final decision being made to go forward with such a partnership.

THAT the Committee recommend to Council that
