Emergency Operations and Communications Centre ("E-Comm") -Closing a Portion of the Lane North of Pender Street Adjacent to Lot 27 of Lot 60,Town of Hastings Suburban Lands, Plan 330
RECOMMENDATION
THAT Council close and stop-up all that portion of lane north of Pender Street being adjacent to Lot 27 of Lot 60, Town of Hastings Suburban Lands, Plan 330 the same as shown hatched on the plan attached hereto as Appendix "A", subject to the following condition:
The subject lane to be closed to be consolidated with Lot 27 and Lot 1 of Lot 60, Town of Hastings Suburban Lands, Plan LMP 30912 to form a single parcel the same as shown in heavy outline on Appendix "A".
COUNCIL POLICY
The authority for closing and disposing of portions of street and lane is set out in the Vancouver Charter.
PURPOSE
The purpose of this report is to seek Council authority to close and stop-up a small portion of lane north of Pender Street for consolidation onto the Emergency Operations and Communications Centre ("E-Comm") site.
BACKGROUND
"E-Comm" occupies Lot 1 of Lot 60, Town of Hastings Suburban Lands, Plan LMP 30912 between Hastings Street and Pender Street, west of the Cassiar Connector. On September 10, 1996, Council approved the report of the General Manager of Engineering Services (dated August 27, 1996) to close and stop-up portions of the lane south of Hastings Street, east from the lane east of Rupert Street and portions of Rupert Street, Hastings Street and the north/south lane in the block all for consolidation with City-owned properties so as to form Lot 1 on which E-Comm is now built.
In acquiring the various properties in the block, the long-time owner of Lot 27 of Lot 60, Town of Hastings Suburban Lands, Plan 330 was an individual (Mrs. Wolff) who wished to remain in her home. In acquiring Lot 27, the City granted Mrs. Wolff a "Life Estate" so she could remain in her home. Mrs. Wolff has passed away, and the Life Estate has been cancelled.
DISCUSSION
Lot 27 and the portion of lane north of Pender Street adjacent to Lot 27 the same as shown hatched on the plan attached hereto as Appendix "A" were originally intended to form a portion of the E-Comm site. The Life Estate prevented Lot 27 and the said lane from being included in the original consolidation.
With cancellation of the Life Estate, Lot 27 and the lane can now be consolidated with the adjacent Lot 1 (E-Comm) to form a single parcel.
CONCLUSION
The General Manager of Engineering Services in consultation with the Director of Real Estate Services and the Director of Legal Services support the closure of the small portion of the lane north of Pender Street adjacent to 27 and recommend its consolidation with the E-Comm lands.
