Extension of Building Permit No. BU406876RECOMMENDATION
THAT City Council approve a final extension of Building Permit No. BU406876 (and 19 related Building Permits) for 7400 Oak Street until June 26, 2001, subject to the site being maintained in a tidy condition, the submission and acceptance of revised plans complying with the new Vancouver Building By-law prior to the commencement of construction and compliance with all current requirements of the Homeowner Protection Office.

The General Manager of Community Services RECOMMENDS approval of the foregoing.
COUNCIL POLICY
Article 1A.7.5.1 of the Building By-law prohibits the Chief Building Official from granting more than one extension to a Building Permit. Any further extensions can only be approved by Council.
DISCUSSION
Building Permit No. BU406876 was issued May 28, 1998 for the construction of a residential complex at 7400 Oak Street, consisting of two multiple dwelling buildings containing 64 dwelling units, 16 townhouse buildings containing 58 dwelling units and thealteration and conversion of the existing Heritage `A' building to provide six dwelling units.
There are 19 related Building Permits for the construction of 19 proposed buildings on the site.The permits were previously extended three times by Council and will expire on November 28, 2000. It is recommended that this be the final extension.
As a new Building By-law (No. 8057) came into effect on November 1, 1999, it is recommended that the permits only be extended on the condition that revised plans are submitted and accepted in accordance with the new By-law prior to the commencement of construction.
As of July 1, 1999, all new residential construction projects required compliance with the Homeowner Protection Office (HPO), including warranty provisions and registration of contractors. The permits for this project were issued prior to the implementation of the HPO requirements. However, due to the delay in commencing construction, it is recommended that these requirements should now be applied to provide protection for future owners/occupants.
A recent inspection determined that the site was in a satisfactory condition.
There has been no change to the zoning for the property (CD-1). Related Development Permit No. DE401826 has been extended and is valid until June 26, 2001. The Planning Department has no objection to this extension.
