A Regular Meeting of the Standing Committee of Council on City Services and Budgets was held on Thursday, September 14, 2000, at 9:30 a.m., in Committee Room No. 1, Third Floor, City Hall.

ADOPTION OF MINUTES
The Minutes of the Standing Committee on City Services and Budgets meeting of July 27, 2000, were adopted.
RECOMMENDATION
1. Demolition of Nuisance/Dangerous Building at
1730 East 5th Avenue File: 2701-1
The Committee had before it an Administrative Report dated August 18, 2000, in which the City Building Inspector recommended that Council declare the building at 1730 East 5th Avenue a nuisance and dangerous to public safety and order the owner to demolish the building, remove all demolition debris and provide a chain-link fence around the perimeter of the property to prevent trespass and/or dumping. It was further recommended that a 336D Notice be filed against the Certificate of Title to the property in order to warn prospective purchasers of Council's resolution. The General Manager of Community Services recommended approval of the foregoing.
Pete Sweeney, Manager, Building Inspection, reviewed the report and introduced Erv Hildebrandt and Sid Kelland, Building Inspectors. Carlene Robbins, By-law Administration, provided overheads of the subject property.
David Campbell, a realtor with RE/MAX, spoke on behalf of the owner, John Neto, who was also present. With the aid of a photograph, Mr. Campbell encouraged retention of the building at 1730 East 5th Avenue, as it is structurally sound with some character. A three month extension to the demolition order was requested to allow sufficient time to properly market the property and find a qualified buyer with the proper renovation skills to upgrade the building to code.
In response to questions from Council, Mr. Sweeney advised once the resolution is passed the City cannot act legally for sixty days. It was also noted if purchase of the building was in progress, the owner could request a 30-day extension to complete the transaction.
The following motion by the Mayor was put.
A. THAT Council declare that the building at 1730 East 5th Avenue, Lot 32 of 2 of C, Block 146, District Lot 264A, Plans 722 & 1771 PID 015-164-438 is a nuisance and dangerous to public safety pursuant to Section 324A of the Vancouver Charter.
B. THAT Council approve the Resolution attached to the Administrative Report dated August 18, 2000, and order the Registered owner of the property to demolish the building, remove the resulting demolition debris and discarded materials from the site and provide a chain-link fence around the perimeter of
the property within 30 days of a copy of the Resolution being served pursuant to Section 324A of the Vancouver Charter.
C. THAT in the event of the failure of the owner to comply with the order of Council, Council further orders and hereby authorizes the City Building Inspector to have the work outlined in Recommendation B above carried out at the expense of the owner.
D. THAT the City Clerk be directed to file a 336D Notice against the Certificate of Title to the property at 1730 East 5th Avenue, in order to warn any prospective purchasers that as a result of the condition of the building and Council's Resolution, the purchaser could suffer a significant expense if the order of Council were enforced against him.

THAT the 30 days referred to in Recommendation B above, be amended to read 90 days.

The amendment having lost, the Mayor's motion was put and carried. The Committee, therefore,
RECOMMENDED

3526 East Georgia Street File: 2701-1
The Committee had before it an Administrative Report dated June 28, 2000, in which the City Building Inspector recommended that Council declare the building and site at 3526 East Georgia Street a nuisance and order the owner to demolish the building, remove all demolition debris and provide a chain-link fence around the perimeter of the property to prevent trespass and/or dumping. It was further recommended that a 336D Notice be filed
against the Certificate of Title to the property in order to warn prospective purchasers of Council's resolution. The General Manager of Community Services recommended approval of the foregoing.

The following motion by Councillor Louis was put and carried. The Committee, therefore,

A. THAT Council declare that the building and site at 3526 East Georgia Street, Lot 4 Except the South 8 Feet Now Lane, of the South l/2 of Lot 88, THSL Plan 2813, PID 007-679-068 are a nuisance and dangerous to public safety pursuant to Section 324A of the Vancouver Charter.
B. THAT Council approve the Resolution attached to the Administrative Report dated June 28, 2000, and order the Registered owner of the property to demolish the building, remove the resulting demolition debris and discarded materials from the site and provide a chain-link fence around the perimeter of the property within 30 days of a copy of the Resolution being served pursuant to Section 324A of the Vancouver Charter.
C. THAT in the event of the failure of the owner to comply with the order of Council, Council further orders and hereby authorizes the City Building Inspector to have the work outlined in Recommendation B above carried out at the expense of the owner.
D. THAT the City Clerk be directed to file a 336D Notice against the Certificate of Title to the property at 3526 East Georgia Street, in order to warn any prospective purchasers that as a result of the condition of the building and Council's Resolution, the purchaser could suffer a significant expense if the order of Council were enforced against him.

3. Demolition of Nuisance/Dangerous Building at
Rear of 2702 Kitchener Street File: 2701-1
The Committee had before it an Administration Report dated August 8, 2000, in which the City Building Inspector recommended that Council declare the condition of the unfinished garage at the rear of the property at 2702 Kitchener Street a nuisance and dangerous to public safety and order the owners to pull down and demolish the structure. It was further recommended that a 336D Notice be filed against the Certificate of Title to the property in order to warn prospective purchasers that there are violations of the City's Building and Standards of Maintenance By-laws related to the rear garage and that there is a resolution of Council against the property. The General Manager of Community Services recommended approval of the foregoing.

The following motion by the Mayor was put and carried. The Committee, therefore,
RECOMMENDED
A. THAT Council declare that the condition of the unfinished garage at the rear of the property at 2702 Kitchener Street, Lot 1, Block 38, Plan 3672, District Lot Sec 32 THSL, PID 009-225-684, is a nuisance and dangerous to public safety pursuant to Section 324A of the Vancouver Charter.
B. THAT Council approve the Resolution attached to the Administrative Report dated August 8, 2000, and order the Registered owner of the property to pulldown and demolish the rear garage within 14 days of a copy of the resolution being served pursuant to Section 324A of the Vancouver Charter.
C. THAT in the event of the failure of the owner to comply with the order of Council, Council further orders and hereby authorizes the City Building Inspector to have the work noted in Recommendation B above, carried out at the expense of the owner.
D. THAT the City Clerk be directed to file a 336D Notice against the Certificate of Title to the property at 2702 Kitchener Street in order to warn prospective purchasers that as a result of Council's Resolution, the purchaser could suffer significant expense if the order of Council were enforced against him.

4. Warning to Prospective Purchasers of 1918 Sasamat Place File: 2701-1
This item was withdrawn from the agenda. The Manager, Building Inspection, advised the owner of 1918 Sasamat, on September 13, 2000, received approval from the Board of Variance to obtain development and building permits.
