BUSINESS LICENSE HEARING MINUTES
JULY 18, 2000
A Business License Hearing of the Council of the City of Vancouver was held on Tuesday, July 18, 2000, in the Council Chamber, Third Floor, City Hall, commencing at 9:30 a.m., to hear an Appeal from the suspension by the Chief License Inspector, pursuant to Section 277 of the Vancouver Charter, of the 2000 Business License issued to Percy Lemaigre, doing business as Native Images Tattoo, 2763 Commercial Drive, Vancouver, British Columbia.

Catherine Kinahan, Corporation Counsel, was present on behalf of the City. The appellant was not present nor was he represented by counsel.
Ms. Kinahan referred the Panel's attention to the following letters which were distributed at the meeting (on file);
· letter to Bruce P. Cran and copied to Danny Markovitz from Catherine Kinahan, dated July 12, 2000;
· letter to Danny Markovitz and copied to Bruce P. Cran from Catherine Kinahan, dated July 17, 2000;
· letter to Bruce P. Cran and copied to Danny Markovitz from Catherine Kinahan, dated July 17, 2000;
· letter to Catherine Kinahan from Bruce P. Cran, dated July 17, 2000.
Ms Kinahan advised that, as per the above-noted July 17, 2000, letter from Bruce P. Cran, both Mr. Cran and Danny Markovitz, acting as counsel for the appellant, Percy Lemaigre, were unavailable for today's hearing and had requested an adjournment to a future date.
Ms. Kinahan provide an overview of the chronology of events in relation to the adjournment, as set out in her above-noted letter dated July 17, 2000, to Bruce P. Cran.
PANEL MEMBERS' DISCUSSION
Panel members expressed concern with regard to public safety in regard to the nature of the criminal conviction against the appellant in relation to the business premises. The Panel therefore agreed to adjourn the Hearing of the Appeal to September 12, 2000, which is the first Hearing date that is available, but ordered that the business premises be closed and remain closed until the Hearing date.
MOVED by Cllr. Clarke,
THAT the Business License Hearing of an Appeal from the suspension by the Chief License Inspector of the 2000 Business License issued to Percy Lemaigre (the Appellant), doing business as Native Images Tattoo (the Business Premises), 2763 Commercial Drive, Vancouver, British Columbia, be adjourned to September 12, 2000, at 9:30 a.m., at the request of Bruce Cran and Danny Markovitz, counsel for the Appellant;
THAT the Appellant is to close the Business Premises forthwith and the Business Premises are to remain closed until the hearing of the Appeal; and
THAT the hearing of the Appeal will proceed on September 12, 2000, at 9:30 a.m., and no further adjournments will be granted.

The Business License Panel adjourned at 9:50 a.m.
