Approval of Minor Encroachment onto City-owned property at 199 Columbia Street
RECOMMENDATION
THAT Council approve the minor encroachment onto City-owned property at 199 Columbia Street, legally described as THAT part of Lot 11 in Reference Plan 1441, Block 2, District Lot 196, Plan 184 and that the encroachment be validated by an easement agreement at nominal charge, drawn to the satisfaction of the Director of Legal Services.

The General Manager of Corporate Services RECOMMENDS approval of the foregoing.
COUNCIL POLICY
There is no applicable Council policy.
PURPOSE
The purpose of this report is to seek Council's approval to allow a minor encroachment of approximately 3.4 cu. metres onto City-owned property at 199 Columbia Street.
BACKGROUND
On January 12, 2000, the owner, Urban Models Ltd., submitted a development permit application (DE404531) for review. It was noted that the outline of the building cornice encroaches onto the City-owned part of Lot 11 in Reference Plan 1441, Block 2, District Lot196, Plan 184. (Appendix A - on file in the City Clerk's Office). The owner did not wish to remove the building cornice, and it was decided that a volumetric easement be obtained in order to validate the encroachment over the City-owned lands.
CONCLUSION
The Director of Real Estate Services is of the opinion that this is a minor encroachment, and will have little effect on the future development potential or the value of the City-owned property.
