COUNCIL POLICY
Section 277.1 of the Vancouver Charter gives Council the power to delegate the holding of a business license hearing under section 275 or section 278, or an appeal under section 277, by Resolution, to one or more Council Members. On November 30, 1999, Council adopted a procedure relating to business license hearings whereby the hearings will generally be conducted before a panel of three Members of Council, although Council may designate that a hearing be conducted before a panel comprised of a greater number of Members of Council.
BACKGROUND
One business license application and one appeal of a business license suspension have been referred to Council by the Chief License Inspector for hearings pursuant to section 275 of the Vancouver Charter in the month of July, 2000. This matters are as follows:
(a) an application for a business license from Samad Ali Rassuli and Fatima Rassuli, doing business as Diamond Fast Foods Ltd., 165 East Hastings Street, Vancouver, British Columbia; and
(b) an appeal of a suspension by the Chief License Inspector of the year 2000 business license issued to Percy Lemaigre, doing business as Native Images Tattoo, 2763 Commercial Drive, Vancouver, British Columbia.
The application for a business license by Samad Ali Rassuli and Fatima Rassuli, doing business as Diamond Fast Foods Ltd., is presently scheduled for hearing on July 11, at 9:30 a.m., with the continuation, if it is necessary, scheduled for July 13, 2000, from 7:30 p.m. to 10:30 p.m., and a further continuation, if necessary, scheduled for July 24, 2000, at 1:30 p.m. The appeal of a suspension by Percy Lemaigre, doing business as Native Images Tattoo, is presently scheduled for hearing on July 18, 2000, at 9:30 a.m.
The new amendment to the Vancouver Charter confers on Council the power to delegate the holding of business license hearings to one or more Members of Council. Council must designate, by Resolution, Members of Council who will deal with each specific hearing. The attached Resolutions will delegate the holding of each of the hearings in the month of July to three named Members of Council.
CONCLUSION
Staff recommend that Council pass the Resolutions contained in this report.
