ADOPTION OF MINUTES
The Minutes of the Standing Committee on Planning and Environment meeting of April 20, 2000, were adopted.
RECOMMENDATION
1. Warning to Prospective Purchasers of 271 East 61st Avenue File: 2701-1
The Committee had before it an Administrative Report dated April 18, 2000, in which the City Building Inspector recommended filing a 336D Notice against the Certificate of Title to the property at 271 East 61st Avenue in order to warn prospective purchasers that there are contraventions of the Zoning and Development and Vancouver Building By-laws related to this building. The General Manager of Community Services recommended approval of the recommendations.
Peter Sweeney, Manager, Building Inspection, with the aid of overheads, provided an overview of the Administrative Report and responded to questions.
The following motion by Mayor Owen was put and carried. The Committee, therefore,
RECOMMENDED
THAT the City Clerk be directed to file a 336D Notice against the Certificate of Title to the property at 271 East 61st Avenue (Lot 33, Block 1, District Lot 326A, Plan 4141) in order to warn prospective purchasers that there are contraventions of the Zoning and Development and Vancouver Building By-laws related to this building.

2. Warning to Prospective Purchasers of 3555 Adanac Street File: 2701-1
The Committee had before it an Administrative Report dated April 26, 2000, in which the City Building Inspector recommended filing a 336D Notice against the Certificate of Title to the property at 3555 Adanac Street to warn prospective purchasers there are contraventions of the Zoning and Development and Vancouver Building By-laws related to this building. It was also recommended the Director of Legal Services, at her discretion, commence appropriate legal action to ensure compliance with City By-laws. The General Manager of Community Services recommended approval of the recommendations.
Peter Sweeney, Manager, Building Inspection and Ian McGillivray, District Building Inspector, with the aid of overheads, provided an overview of the Administrative Report and responded to questions.
The following motion by Councillor Louis was put and carried. The Committee, therefore,
RECOMMENDED
A. THAT the City Clerk be directed to file a 336D Notice against the Certificate of Title to the property at 3555 Adanac Street (Lot 24, Block 88 S Hlf, THSL, Plan 2813) in order to warn prospective purchasers that there are contraventions of the Zoning and Development and Vancouver Building By-laws related to this building.
B. THAT the Director of Legal Services is hereby authorized, in her discretion, to commence a legal action or proceeding in relation to the premises located at 3555 Adanac Street and may, in her discretion, seek injunctive relief in that action or proceeding, in order to bring this building into compliance with City By-laws.

3. Nuisance Building at Rear of 1250 Rossland Avenue File: 2701-1
The Committee had before it an Administrative Report dated May 1, 2000, in which the City Building Inspector recommended the unfinished garage at the rear of 1250 Rossland be declared a nuisance, that the owner be ordered to complete the work as outlined in the Administrative Report and that in the event of failure to comply, the work be completed at the owner's expense. It was also recommended that a 336D Notice be filed against the Certificate of Title to the property to warn prospective purchasers there are violations of the City By-laws related to this building and of Council's resolution. The General Manager of Community Services recommended approval of the recommendations.

The following motion by Councillor Clarke was put and carried. The Committee, therefore,
RECOMMENDED
A. THAT Council declare that the unfinished condition of the exterior of the garage under construction at the rear of the property at 1250 Rossland Avenue, Lot 5 Except the East 4.25 feet now lane, Block 3, southeast l/4 of Section 23, THSL, Plan 4819, PID 011-325-119, is a nuisance pursuant to Section 324A of the Vancouver Charter.
B. THAT Council approve the Resolution attached to the Administration Report dated May 1, 2000, and order the Registered owner of the property to complete the exterior of the garage with building paper and exterior siding, within 14 days of a copy of the resolution being served pursuant to Section 324A of the Vancouver Charter.
C. THAT in the event of the failure of the owner to comply with the order of Council, Council further orders and hereby authorizes the City Building Inspector to have the work noted in Recommendation B above, (including replacement of any deteriorated sheathing if required) carried out at the expense of the owner.
D. THAT the City Clerk be directed to file a 336D Notice against the Certificate of Title to the property at 1250 Rossland Avenue in order to warn prospective purchasers that as a result of Councils Resolution, the purchaser could suffer significant expense if the order of Council were enforced against him.

4. Demolition of Nuisance/Dangerous Building at File: 2701-1
5092 Hoy Street
The Committee had before it an Administrative Report dated April 17, 2000, in which the City Building Inspector recommended the building at 5092 Hoy Street be declared a nuisance and dangerous to public safety; that the owner be ordered to demolish the building, remove all demolition debris and provide a chain-link fence around the perimeter of the property and that in the event of failure to comply, the required action be completed at the expense of the owner. It was also recommended that a 336D Notice be filed against the Certificate of Title to the property at 5092 Hoy Street order to warn prospective purchasers that due to the condition of the building and Council's resolution, the purchaser could suffer significant expense. The General Manager of Community Services recommended approval of the recommendations.

The following motion by Councillor McCormick was put and carried. The Committee, therefore,
RECOMMENDED
A. THAT Council declare that the vacant building at 5092 Hoy Street, Lot 16, Blocks 62 and 111, District Lots 36 and 51 Plan 7708 PID 010-365-150 is a nuisance and dangerous to public safety pursuant to Section 324A of the Vancouver Charter.
B. THAT Council approve the Resolution attached to the Administrative Report dated April 17, 2000 and order the Registered owner of the property to demolish the building, remove all demolition debris from the site and provide a chain-link fence around the perimeter of the property within 30 days of a copy of the Resolution being served pursuant to Section 324A of the Vancouver Charter.
C. THAT in the event of the failure of the owner to comply with the order of Council, Council further orders and hereby authorizes the City Building Inspector to have the building demolished, have all demolition debris removed from the site and provide a chain-link fence around the perimeter of the property at the expense of the owner.
D. THAT the City Clerk be directed to file a 336D Notice against the Certificate of Title to the property at 5092 Hoy Street, in order to warn any prospective purchasers that because of the condition of the building and Councils Resolution, the purchaser could suffer a significant expense if the order of Council were enforced against him.

5. Proposed Amendment to Subdivision By-law No. 5208 File: 5302-113
Affecting Lands in the RA-1 Zone
The Committee had before it an Administrative Report dated May 2, 2000, in which the Subdivision Approving Officer, in consultation with the Director of Current Planning,
sought direction on a request from the owner of 1850 SW Marine Drive for an amendment to Subdivision By-law 5208 to allow the recreation of a previously existing subdivision pattern.
Rick Scobie, Subdivision Approving Officer and Dave Thomsett, Senior Rezoning Planner, reviewed the report and responded to questions.
The following spoke in favour of the proposed amendment to the subdivision By-law:
John Weston, representing Owner
George Horner, representing Owner
Speakers' comment included:
· the owner's intent is to dispose of house on the upper portion of the property, but would prefer to determine long-term use of lower property at a later date without rezoning at this time
· it was suggested a restrictive covenant could be written to ensure the needs of both the City and owner are met
Mr. Scobie advised that while a restrictive covenant could not rule out or preclude all forms of development, it could be written to cover most of the troublesome issues.
The following motion by Councillor Louis was put and carried. The Committee, therefore,
RECOMMENDED
THAT the decision regarding the proposed amendment to Subdivision By-law No. 5208 Affecting Lands in the RA-1 Zone specifically relating to 1850 SW Marine Drive be postponed so that staff can review with the applicant the possibility of developing a restrictive covenant to cover the RA-1 Zoning concerns.

6. West End Liquor Licensing Policy File: 2611/8111
The Committee had before it a Policy Report dated May 2, 2000, in which the Chief License Inspector, the Director of Current Planning and the Director of Social Planning, sought approval for a liquor licensing policy for the West End neighbourhood.
Michael Gordon, Senior Planner, Current Planning, reviewed the report and responded to questions. He noted an error on Page 5 of the Policy Report: there are 2, not 5, licensed pubs in the West End (Dover Arms in Denman Village and Fountainhead Pub in Davie Village).
The following spoke in favour of the recommendations:

Steve Bauer, Davie Village Liaison Association
Mary Larsen, Davie Street Community Policing Centre
Gillan Jackson, Central Presbyterian Church
Don Kopeck, West End resident
Speakers' comments included:
· smaller establishments create sense of community and enhance area's image
· benefits of smaller establishments is taking place through street beautification, increased sense of safety
· high streets are beneficial as they minimize the impact on residential areas
· the West End population of 35,000 would be better served with smaller establishments being introduced to the area
· there is increased cooperation between various community organizations, the City and the Police and through this direct dialogue with the public is improving
Inspector Dave Jones, Vancouver Police Department and Mr. Gordon noted the VPD and City staff are working with community groups already in place, including BarWatch.
Blaine Culling, Granville Entertainment Group, spoke in favour of the recommendation, but noted the policies recommended for cabarets in the West End differ from those for Granville Theatre Row. He requested these inequities be addressed prior to Council making a decision relating to cabarets.
Paul Teichroeb, Chief License Inspector, advised the issues of cabarets will be dealt with in upcoming reports relating to Granville Theatre and the Central Business District.
The following motion by Councillor Clarke was put and carried. The Committee, therefore,
RECOMMENDED
A. THAT allowance be made for up to 7 additional Class D Neighbourhood Pubs in 2 phases (Phase 1 - 2000 - mid-2002 [4 Pubs] and Phase 2 - mid-2002 -2004 [3 Pubs] generally distributed and phased as follows:
1. Davie Village:
- 1000 block of Davie Street (Phase 1 - 1 neighbourhood pub with up to 65 seats and 20 patio seats);
- 1100 block of Davie Street (Phase 1 - 1 neighbourhood pub with up to 65 seats and 20 patio seats; and Phase 2 - 1 neighbourhood pub with up to 40 seats and 10 patio seats);
- 1200 block of Davie Street (Phase 1 - 1 neighbourhood pub with up to 40 seats and 10 patio seats; and Phase 2 - 1 neighbourhood pub with up to 40 seats and 10 patio seats);
- and, in addition, the opportunity for 1 Restaurant - Class 2 in the Davie Street Village (1000-1200 block) with up to 100 seats and 20 patio seats;
2. Denman Village - includes Denman Street (700-1200 blocks), and Robson Street (1500-1700 blocks) and Davie Street (1500-1700 blocks):
- Phase 1 - 1 neighbourhood pub with up to 40 seats and 10 patio seats and;
- Phase 2 - 1 neighbourhood pub with up to 40 seats and 10 patio seats; and
- FURTHER THAT the pubs will not be approved on block faces that contain an existing pub, cabaret or class two - restaurant.
B. THAT before considering the opportunities for liquor licenses provided for in Phase 2, staff report back on any relevant issues regarding the licensed premises in the West End, noting that the consideration of applications provided for in Phase 2 is contingent on staff recommendations regarding the operation and impacts of the licensed establishments approved as part of Phase 1 and further that as part of this report back, staff consult with West End businesses, residents and community organizations.
C. THAT Council endorse the proposal to allow Class D Neighbourhood Pubs to open at 7:00 a.m. in the West End, to serve breakfast, noting that alcohol service would be limited to the hours of operation permitted on their existing liquor license.
D. THAT Council encourage the operators holding liquor licenses in the West End, other neighbourhood businesses and West End community organizations, including the Community Policing Offices, residents associations, the Davie Street Business Improvement Association, the West End Community Association, Gordon House and the West End Seniors Network to establish on-going liaison that will foster communication and address issues of mutual concern.
E. THAT a decision on 1 Class C Cabaret as detailed below be postponed until the Central Business District report is presented to Council:
Robson Village and Burrard Street - includes Robson Street (1000-1700 block, includes north side only of 1700 block) and Burrard Street (800-1000 block):
- 1 cabaret, in conjunction with a hotel with up to 225 seats.
