Business License Hearing Panels for May 2000
RECOMMENDATION
A. THAT Council delegate the holding of three business license hearings, presently scheduled for May, 2000, to a panel of three Council Members, pursuant to Section 277.1 of the Vancouver Charter, as follows:
i. The business license suspension appeal hearing pursuant to Section 277 of the Vancouver Charter, regarding the year 2000 business license issued to Carmel Club Ltd., doing business as The Carmel Club, 6045 Fraser Street, Vancouver, British Columbia, and the power to make a Council decision in relation to that application, be delegated to:
Councillor Daniel Lee (Chair)
Councillor Sandy McCormick
Councillor Sam SullivanShould any of the above Members of Council be unable to attend the hearing, the hearing and the power to make a Council decision in relation to the application be delegated to the remaining two Councillors and Councillor George Puil.
ii. The business license hearing pursuant to Section 275 of the Vancouver Charter, regarding an application for a business license by Stadium Equities Ltd., doing business as West Hotel Pub, 488 Carrall Street, Vancouver, British Columbia, and the power to make a Council decision in relation to that application, be delegated to:
Councillor Fred Bass (Chair)
Councillor Daniel Lee
Councillor Sandy McCormickShould any of the above Members of Council be unable to attend the hearing, the hearing and the power to make a Council decision in relation to the application be delegated to the remaining two Councillors and Councillor Don Lee.
iii. The business license hearing pursuant to Section 275 of the Vancouver Charter, regarding an application for a business license by Leon Lam, doing business as Alice Fong, at the Nortel Lodging House, 1190 East Hastings Street, Vancouver, British Columbia, and the power to make a Council decision in relation to that application, be delegated to:
Councillor George Puil (Chair)
Councillor Fred Bass
Councillor Gordon PriceShould any of the above Members of Council be unable to attend the hearing, the hearing and the power to make a Council decision in relation to the application be delegated to the remaining two Councillors and Councillor Sandy McCormick.
CITY MANAGER'S COMMENTS
The City Manager RECOMMENDS approval of the foregoing.
COUNCIL POLICY
Section 277.1 of the Vancouver Charter gives Council the power to delegate the holding of a business license hearing under section 275 or section 278, or an appeal under section 277, by Resolution, to one or more Council Members. On November 30, 1999, Council adopted a procedure relating to business license hearings whereby the hearings will generally be conducted before a panel of three Members of Council, although Council may designate that a hearing be conducted before a panel comprised of a greater number of Members of Council.
BACKGROUND
Two business license applications and one appeal from a license suspension have been referred to Council by the Chief License Inspector for hearings pursuant to section 275 or277 of the Vancouver Charter in the month of May, 2000. Those matters are as follows:
(a) an appeal from a suspension by the Chief License Inspector pursuant to section 277 of the Vancouver Charter regarding the year 2000 business license issued to Carmel Club Ltd., doing business as The Carmel Club, 6045 Fraser Street, Vancouver, British Columbia;
(b) an application for a business license from Stadium Equities Ltd., doing business as West Hotel Pub, 488 Carrall Street, Vancouver, British Columbia; and
(c) an application for a business license from Leon Lam, doing business as Alice Fong, Nortel Lodging House, 1190 East Hastings Street, Vancouver, British Columbia.
The appeal by Carmel Club Ltd., doing business as The Carmel Club, is presently scheduled for hearing on May 16, 2000, at 9:30 a.m. The application for a business license from Stadium Equities Ltd., doing business as West Hotel Pub, is presently scheduled for hearing on May 18, from 7:30 p.m. to 10:30 p.m. The application for a business license from Leon Lam, doing business as Alice Fong, is presently scheduled for hearing on May 29, from 9:30 a.m. to 5:00 p.m.
The new amendment to the Vancouver Charter confers on Council the power to delegate the holding of business license hearings to one or more Members of Council. Council must designate, by Resolution, Members of Council who will deal with each specific hearing. The attached Resolutions will delegate the holding of each of the hearings in the month of May to three named Members of Council.
CONCLUSION
Staff recommend that Council pass the Resolutions contained in this report.
