Business License Hearing Panels for April 2000
RECOMMENDATION
THAT Council delegate the holding of two business license hearings, presently scheduled for April, 2000, to a panel of three Council Members, pursuant to Section 277.1 of the Vancouver Charter, as follows:
i. The business license hearing pursuant to Section 275 of the Vancouver Charter, regarding an application for a business license by Elena Bruzzese, doing business as The Gourmet Shop, 3885 Rupert Street, Vancouver, British Columbia, and the power to make a Council decision in relation to that application, be delegated to:
Mayor Philip Owen (Chair)
Councillor Daniel Lee
Councillor Jennifer ClarkeShould any of the above Members of Council be unable to attend the hearing, the hearing and the power to make a Council decision in relation to the application be delegated to the remaining two Councillors and Councillor Lynne Kennedy.
ii. The business license hearing pursuant to Section 275 of the Vancouver Charter, regarding an application for a business license by Mancharambath Velayudhan, doing business as Van's Grocery, 757 East Broadway, Vancouver, British Columbia, and the power to make a Council decision in relation to that application, be delegated to:
Councillor Gordon Price (Chair)
Councillor Lynne Kennedy
Councillor Jennifer ClarkeShould any of the above Members of Council be unable to attend the hearing, the hearing and the power to make a Council decision in relation to the application be delegated to the remaining two Councillors and Councillor Sandy McCormick.
CITY MANAGER'S COMMENTS
The City Manager RECOMMENDS approval of the foregoing.
COUNCIL POLICY
Section 277.1 of the Vancouver Charter gives Council the power to delegate the holding of a business license hearing under section 275 or section 278, or an appeal under section 277, by Resolution, to one or more Council Members. On November 30, 1999, Council adopted a procedure relating to business license hearings whereby the hearings will generally be conducted before a panel of three Members of Council, although Council may designate that a hearing be conducted before a panel comprised of a greater number of Members of Council.
BACKGROUND
Two business license applications have been referred to Council by the Chief License Inspector pursuant to section 4(2a) of the License By-law, for hearings pursuant to section 275 of the Vancouver Charter in the month of April, 2000. Those matters are as follows:
(a) an application for a year 2000 business license from Elena Bruzzese, doing business as The Gourmet Shop, 3885 Rupert Street, Vancouver, British Columbia; and
(b) an application for a business license from Mancharambath Velayudhan, doing business as Van's Grocery, 757 East Broadway, Vancouver, British Columbia.
The application by Elena Bruzzese, doing business as The Gourmet Shop, is presently scheduled for hearing on April 4, 2000, from 9:30 a.m. to 12:30 p.m. The application by Mancharambath Velayudhan, doing business as Van's Grocery, is presently scheduled for hearing on April 17, 2000, from 9:30 a.m. to 12:30 p.m.
The new amendment to the Vancouver Charter confers on Council the power to delegate the holding of business license hearings to one or more Members of Council. Council must designate, by Resolution, Members of Council who will deal with each specific hearing. The attached Resolutions will delegate the holding of each of the hearings in the month of April to three named Members of Council.
CONCLUSION
Staff recommend that Council pass the Resolutions contained in this report.
