A. THAT the City Clerk be directed to file a 336D Notice against the Certificates of Title to the property at 7978 - 7988 Main Street in order to warn prospective purchasers that there are contraventions of the Zoning and Development and Vancouver Building By-laws related to this building.

The General Manager of COMMUNITY SERVICES recommends approval of the foregoing.
COUNCIL POLICY
Section 336D of the Vancouver Charter provides a mechanism whereby the City of Vancouver can warn prospective purchasers of contraventions of City By-laws relating to land or a building or structure. It provides that if the City Building Inspector observes a condition that he considers is of a nature that a purchaser unaware of the contravention, would suffer a significant loss of expense if the by-law were enforced against him, he may recommend to City Council that a resolution be considered directing the City Clerk to file a notice against the Title to the property in the Land Title Office.
BACKGROUNDThe approved use of this building is a side-by-side two family dwelling that was constructed in 1999 and received final inspection approval on September 24, 1999. At the end of October, 1999, the District Building Inspector reported that enclosure additions (approximately 8' x 20' each) were being constructed above and below the decks at the rear of both dwelling units without permit or approval.
Consequently, the owners were ordered to stop work at the site immediately and were advised to obtain the required permits or remove the unapproved additions. As no applications for permits were submitted, the owners were ordered to remove the unauthorized additions. To date, they have not complied and the matter has been referred to the City Prosecutor for charges.
DISCUSSION
The District Building Inspector advises that one of the dwelling units has been sold and that the other is currently listed for sale.
The filing of 336D Notices against the Certificates of Title to this property will warn any prospective purchasers that there are outstanding violations of the Zoning and Development and Vancouver Building By-laws related to this building.
