SUBJECT: Local Improvements Subsequent Procedure - February 15, 2000

RECOMMENDATION

COUNCIL POLICY

Policies governing the Local Improvement process are set out in the Vancouver Charter and Local Improvements Procedure by-law.

PURPOSE

Projects by Petition and on the Initiative Principle have been advanced under the provisions of the Local Improvements Procedure By-law and will come before a Court of Revision on February 15, 2000.

The projects are identified as follows:

Court #592, Item #33, Pavement & Curbs & Trees & Bulges
Cambridge Street from Slocan Street to Kaslo Street

A petition for this project was returned with sufficient support to carry it forward to a Court of Revision. The petition information that was sent to the owners advised them that the street width would be 8.5 metres and they signed the petition based on this information. However, one of the owners demanded a street width wider than 8.5 meters, citing safety as an issue and that other owners felt this way as well.

The Neighbourhood Transportation Branch reviewed the request and advised that the wider width was not appropriate. During the review the owners were balloted to determine whether they support the street improvement at 8.5 meters or only support the improvement at the wider width or whether they oppose the improvement altogether.

Based on the ballots returned and follow-up phone call, the results are as follows:

Of the three owners who did not respond, all three had signed the original petition. One was contacted by phone and was in favour of the standard 8.5 metre width. Based on these results
we recommend this project proceed.

Lane south of 7th Avenue from McLean Drive to Woodland Drive

This project is being withdrawn because of a major property development occurring on the west side of the lane later this year.

Court #593, Item #12, Lane Pavement
Lane south of 1st Avenue from the lane east of Clark Drive to McLean Drive and the lane east of Clark Drive from 1st Avenue to 2nd Avenue

This project is being withdrawn due to opposition from owners who are adjacent to the lane. These owners do not form a majority in votes but they do comprise a majority of the assessable length.

Lane south of 3rd Avenue from Larch Street to Balsam Street

This project is being withdrawn at this time to evaluate safety concerns raised by adjacent owners. This project may be initiated again at a later date after a safety review and input from adjacent owners.

Court #593, Item #19, Speed Humps
Lane south of Nelson Street from Chilco Street to Gilford Street

This project is being withdrawn at the request of two strata councils (comprising of a total of 88 owners) who claim there is not a speeding problem and that noise from vehicles encountering the speed humps would be disturbing to units adjacent to the humps.

Capital Funds

Funds for the City's share of the projects are available from existing Engineering Department Basic Capital Accounts or are subject to approval of the 2000 Streets Basic Capital Budget.
