SUBJECT: 668 Powell Street - Proposed Closure of a Portion of the South Side of Powell Street, West of Heatley Avenue
 

RECOMMENDATION

COUNCIL POLICY

PURPOSE

The purpose of this report is to obtain Council authority to close and stop-up a portion of the south side of Powell Street, west of Heatley Avenue (see Appendix "A") with the abutting City-owned lands.
BACKGROUND

The City owns in title, the North 7 feet of Lots 11, 12, 13 and 14, all of Block 52, District Lot 196, Plan 196. The North 7 feet of Lots 11, 12, 13 and 14 were established as road by document filed 32694, in 1941.

DISCUSSION

On November 30, 1999, the City acquired Lots 11, 12, 13 and 14, except the North 7 Feet of each lot, now road, all of Block 52, District Lot 196, Plan 196 (see Appendix "A"). The lands are subject to a development permit application now under review (*P401208). This application is for the construction of social housing. A request has been received to consolidate the 7 feet of road shown hatched on the plan attached (see Appendix "A") with the abutting City-owned lands. The requirement for Powell Street at this location is 66 feet. The present width of the road is greater than 66 feet. Therefore, the residual strip, 7 feet in width, on the north side of the Remainder of Lots 11, 12, 13 and 14 is no longer required for road purposes. As such, it can be closed, stopped-up, and consolidated with Lots 11, 12, 13 and 14, except the North 7 Feet of each lot, now road, all of Block 52, District Lot 196, Plan 196.

The value of the abutting City-owned lands, as provided by the Manager of Real Estate Services, is $52 per square foot. Therefore, the value of the portion of road (700 square feet) to be closed is determined to be $36,400. As the abutting lands are City-owned and the development application is for social housing, the General Manager of Engineering Services supports the road being closed without any transfer of funds between internal departments. The portion of road to be closed will be consolidated with the abutting Remainder of Lots 11, 12, 13 and 14 to form a single parcel, to the satisfaction of the Director of Legal Services.

CONCLUSION

The General Manager of Engineering Services, in consultation with the Manager of Real Estate Services, recommends approval of the Recommendation.
