1. Warning to Prospective Purchasers of 382 East 13th Avenue File: 2701-1
The Committee had before it an Administrative Report dated December 15, 1999, in which the City Building Inspector reported on the deficiencies and contraventions of the Zoning and Development, Vancouver Building and Electrical By-laws relating to the building at 382 East 13th Avenue and recommended commencement of injunction proceedings.
Peter Sweeney, Manager, Building Inspection reviewed the report and provided a history of the building relating to violations.
Dave Jhooty, one of three owners of the building, advised that approving the 336D notice would create a financial burden to the owners and that he had made every effort to comply with previous directives of staff. Mr. Sweeney advised that this situation has been on-going since 1995 and very few improvements have been made.
Clause No. 1 (cont'd)
The following motion by Councillor Louis was put and carried. The Committee, therefore,
RECOMMENDED
A. THAT the City Clerk be directed to file a 336D Notice against the Certificate of Title to the property at 382 East 13th Avenue (Lot 8 Block 112 District Lot 301 Plan 187 Exc Plan 4153), in order to warn prospective purchasers that there are contraventions of the Zoning and Development and Vancouver Building By-laws related to this building.
B. THAT the Director of Legal Services be instructed to commence injunction proceedings to obtain compliance with City by-laws at this address.

C. THAT in the event of the failure of the owner to comply with the order of Council, Council further orders and hereby authorizes the City Building Inspector to have the work noted in Recommendation B above carried out at the expense of the owner.
D. THAT the City Clerk be directed to file a 336D Notice against the Certificate of Title to the property at 4124 West 14th Avenue in order to warn prospective purchasers that as a result of Councils Resolution, the purchaser could suffer significant expense if the order of Council were enforced against him.
