Strata Title Conversion - 1353 & 1355 Cypress Street
RECOMMENDATION
THAT the application to convert the previously-occupied building at 1353 and 1355 Cypress Street (Lot A, Block 176A, D.L. 526, Plan LMP36207) to strata title ownership be approved.

The General Manager of Community Services RECOMMENDS approval of the foregoing.
COUNCIL POLICY
Council policy is reflected in the Citys Strata Title and Cooperative Conversion Guidelines, which outline factors which Council will consider in reviewing applications for converting previously-occupied buildings to strata title or cooperative ownership.
PURPOSE
Council approval is required for an application to convert the previously-occupied building at 1353 and 1355 Cypress Street (Lot A, Block 176A, D.L. 526, Plan LMP36207) to strata title ownership.
BACKGROUND
The site is zoned RT-9 and is developed with a two-family dwelling, which was constructed in 1998 in accordance with approved Development and Building Permits. An Occupancy Permit was issued in April, 1999. The location of the building is shown in Figure 1, below.

The dwelling units are both owner occupied and have never been tenanted. The owners always intended to strata title their building but did not realize that following their occupancy, City approval for the conversion would be required.
STAFF ANALYSIS
In addition to Planning Department staff, the City Engineer and the City Building Inspector have reviewed this application. As the building contains only two dwelling units and is owner occupied, the Manager of the Housing Centre has not been asked to comment.
The City Engineer advises that there are no servicing or dedication requirements for this site.
The City Building Inspector reports that based on the inspections that have been carried out and the issuance of an Occupancy Permit, this building substantially complies with all relevant City By-laws.
CONCLUSION
Based on the foregoing, and on the applicants compliance with the Citys Strata Title and Cooperative Conversion Guidelines, the Subdivision and Strata Title Coordinator supports this application.
