TO: Vancouver City Council FROM: General Manager of Engineering Services in Consultation with the Manager of Real Estate Services SUBJECT: Closure of a Portion of Stewart Street, East of Victoria Drive RECOMMENDATION
THAT Council close, stop up and convey to Her Majesty the Queen in Right of Canada as represented by the Vancouver Port Authority all that portion of Stewart Street, east of Victoria Drive, the same as shown hatched on the plan attached hereto as Appendix "A" subject to the following conditions:
1. The portion of Stewart Street to be closed to be consolidated with the adjacent Parcel N, Block 17, District Lot 184 and the Public Harbour of Burrard Inlet, Plan LMP 35865 the same as shown in heavy outline on Appendix "A" to the satisfaction of the Director of Legal Services ;
2. The conveyance to be for the price of $356,260 plus GST if applicable for the 1408 square metre (15,160 square foot) portion of Stewart Street to be closed in accordance with the recommendation of the Manager of Real Estate Services;
3. Any agreements are to be to the satisfaction of the Director of Legal Services;
4. No legal right or obligation shall be created and none shall arise hereafter, until the documents are executed.
COUNCIL POLICY
The authority for closing and disposing of street and lanes is set out in the Vancouver Charter.
PURPOSE
This purpose of this report is to obtain Council authority to close, stop-up and convey all that portion of Stewart Street, east of Victoria Drive (see Appendix "A") to Her Majesty the Queen in Right of Canada as represented by the Vancouver Port Authority.
BACKGROUND
On December 14, 1999 Council approved the report of the Manager of Real Estate Services that details the sale of Parcel N, Block 17, District Lot 184 and the Public Harbour of Burrard Inlet, Plan LMP 35865.
That recommendations in that report included:
"FURTHER THAT Council instruct the General Manager of Engineering Services to report back on the viability of conveying the portion of Stewart Street shown hatched on Appendix A. If such a conveyance is feasible, the price to be $356,260."
DISCUSSION
Engineering Services has now completed a review of the subject portion of Stewart Street and determined that it is surplus to our needs.
As such, it can be closed, stopped-up, and conveyed to Her Majesty the Queen in Right of Canada as represented by the Vancouver Port Authority, subject to its consolidation with Parcel N.
CONCLUSION
The General Manager of Engineering Services, in consultation with the Manager of Real Estate Services, recommends approval of the Recommendation.
