Amendment of Private Property Tree By-law

 

RECOMMENDATION

GENERAL MANAGER'S COMMENTS

COUNCIL POLICY

On October 7, 1997, Council enacted amendments to the Private Property Tree By-law No. 7347 to improve various aspects of the By-law.

PURPOSE

The purpose of this report is to correct two deficiencies in the Private Property Tree By-law.

DISCUSSION

The recommended amendments to the Private Property Tree By-law No. 7347 in 1997 were intended, among other things, to improve the enforcement capabilities of the By-law. Unfortunately, the then existing Section 10 clause (b) was unintentionally deleted as a result of other changes to that Section.

The previous clause (b), important to the enforcement of the By-law, stated "No person shall remove a tree without first obtaining a tree permit". This clause should be reinstated as outlined in Appendix A.

A typographical housekeeping amendment correcting a spelling error is included in Appendix B.

CONCLUSION

Staff recommend approval of these proposed amendments to conform with the intentions of the previously-enacted By-law.

Proposed Amendments to the Private Property Tree By-law No. 7347

PROHIBITIONS

Add a new clause (a) to Section 10, such that the existing clauses (a) and (b) become (b) and (c).

Section 10 No person shall:

To reinstate Section 10 (b) that was in the By-law for enforcement purposes prior to the enactment of amendments on October 7, 1997.
