RECOMMENDATION

COUNCIL POLICY

On April 27, 1984, the City of Vancouver entered into the Infrastructure Agreement with the Provincial Crown Corporation, British Columbia Place Ltd., which outlined cost-sharing arrangements for the design and construction of water, sewer, and road infrastructure within an area of the False Creek North lands, which also contains Concord Pacific Place.

On April 2, 1996, Council approved the CD-1 rezoning application for 500 Pacific Street (Beach Neighbourhood East Area 1B), in which the Services Agreement required that Pacific Place provide a site for the sewer pump station to replace the existing pump station located at Granville Street and Beach Avenue.

On March 23, 1999, Council referred to Public Hearing, a report on the CD-1 rezoning application for 600 Pacific Street (Beach Neighbourhood West Area 1A), which included consolidation of City, Provincial, and Pacific Place lands around Granville Street and Beach Avenue, and proposed that the new sewer pump station be located on a portion of Lot 167.

PURPOSE

The purpose of this report is to seek Council authority to proceed with the establishment as Road a portion of Lot 167, False Creek, Plan 20639, for the purpose of constructing a sewer pump station.

BACKGROUND

On April 27, 1984, the City of Vancouver entered into the Infrastructure Agreement with British Columbia Place Ltd., which outlined cost-sharing arrangements for the design and construction of civic infrastructure within a large portion of False Creek North lands owned by British Columbia Place Ltd. Part of the required infrastructure included a new sanitary pump station to be located within the BC Place lands to the west near the Granville Bridge. The existing sewer pump station at Granville Street and Beach Avenue has exceeded its expected lifespan and does not have sufficient capacity to meet the growing demands of re-development in the False Creek North lands.

In the late 1980's, the Province sold portions of the lands owned by BC Place Ltd. to Concord Pacific Developments Ltd., who assumed the obligations of the Infrastructure Agreement as it related to their lands. The requirement for Concord Pacific to supply the lands for the new sanitary pump station and to cost share in the design and construction of the facility was reaffirmed in the Services Agreement of the CD-1 rezoning of the Area 1B -Beach Neighbourhood East lands.

DISCUSSION

With the recent CD-1 rezoning application by Pacific Place Holdings Ltd. (PPHL) for the Area 1A - Beach Neighbourhood West lands, the location for the new sanitary pump station was reviewed in the design and layout of the development proposal. Following a technical review of the pump station, it was determined that the most desirable site for the facility would be a City-owned site, Lot 167, at the base of Granville Street. PPHL also preferred this site, since a pump station facility within their lands could negatively impact their development potential.

This lot is currently leased to the Province, who has sub-leased the lands to the False Creek Yatch Club. The lot is currently used for access and parking by the FCYC and Andersons restuarant. PPHL entered into discussions and negotiations with the FCYC and all other parties with a registered interest in the lands, to secure the portion of Lot 167 for the sewer pump station. On October 30, 1998, PPHL entered into an agreement with FCYC, in which the FCYC released and surrendered its interests in the portion of Lot 167 (Appendix A), to allow the construction and existence of a sanitary sewer pump station. All other registered parties, with the exception of the Province, have also granted their consent to this establishment of a portion of Lot 167 as Road. Initial discussions with the Province have indicated that they are willing to allow the establishment of this portion of Lot 167 as Road, for the purposes of a sewer pump station.

As the sole use of this lot will be to accommodate a sewer pump station, forming part of the City's infrastructure, it is appropriate that this lot be established as Road. Council authorization is required at this time to complete this establishment and to proceed with the design and construction of the new sewer pump station. Staff will also secure the neccessary approvals from the Province, prior to establishment.
