1025 to 1075 East Pender Street - Proposed Closure of the North Side of East Pender Street, West of Glen Drive

 

RECOMMENDATION

COUNCIL POLICY

The authority for closing and disposing of street and lanes is set out in the Vancouver Charter.

PURPOSE

The purpose of this report is to obtain Council approval to close, stop-up and convey to the abutting owner, a portion of the north side of East Pender Street, west of Glen Drive.

DISCUSSION

An application has been received to purchase the 7 feet of road shown hatched on the plan hereto, attached as Appendix "A", and abutting Lot 11, except the South 7 feet, now road, Block 64, District Lot 181, Plan 196 (1025 to 1075 East Pender Street). The present width of the road is 73 feet at this location and our requirement for East Pender Street is only 66 feet. Therefore, the residual strip, 7 feet in width, on the south side of the Remainder of Lot 11, 175 square feet (16.3 square metres), is no longer required for road purposes and could be closed, stopped-up and sold to the abutting owner.

The owner of the Remainder of Lot 11 has agreed to pay $7,000, plus G.S.T., if applicable, for the 175 square feet of road to be closed. The City owns in title, the South 7 feet of Lot 11, Block 64, District Lot 181, Plan 196. The South 7 feet of Lot 11 was established as road, by document filed 40818, in 1945. The portion of road to be closed will be consolidated with the abutting Lot 11 and additional lands to form a single parcel, to the satisfaction of the Director of Legal Services. We note that the lands are subject to a Development Permit Application now under review. The abutting owner is to be responsible for all plans and documents.

In the opinion of the Manager of Real Estate Services, the sale price is fair and reasonable.
