SUBJECT:Local Improvement Reballots from June 17, 1997 Court of Revision

RECOMMENDATION

A.THAT Court #579, Item #008 BE APPROVED for lane lighting on the lane south of 10th Avenue from Clark Drive to Woodland Drive.

B.THAT Court #579, Item #017 NOT BE APPROVED for pavement and curbs and trees on Adanac Street from Penticton Street to Slocan Street.

C.THAT Court #579, Item #019 BE APPROVED for pavement and curbs and trees on 34th Avenue from Blenheim Street to Balaclava Street.

D.THAT Court #579, Item #020 NOT BE APPROVED for pavement and curbs and trees on 43rd Avenue, South Side, from Gladstone Street to Stirling Street and on the North Side from Gladstone Street to the east property line of Lot 35 DL 720 N1/2 of west portion Plan 3553 (2293 East 43rd Avenue).

E.THAT Court #579, Item #036 NOT BE APPROVED for lane pavement on the lane south of 10th Avenue from Clark Drive to Woodland Drive.

COUNCIL POLICY

Policies governing the Local Improvement Process are set out in the Vancouver Charter and the Local Improvement Procedure By-Law. The projects dealt with in this report have gone through the legal requirements in the process, but Council has requested additional information on project support/opposition through reballots before giving final approval.

PURPOSE

At the June 17, 1997 Court of Revision, Council instructed staff to reballot these local improvement petition projects.

This has been done and the results are as follows:

Court #579, Item #008, Lane Lighting on the lane south of 10th Avenue from Clark Drive to Woodland Drive

Number of owners 38

Required 2/3 majority 26

Ballot results: In Favour 24

Opposed 9

Responses 33

The five owners who did not return their ballots were sent a second ballot and still did not respond. Of these five owners three had signed the original petition. If these owners are assumed to be in favour, there is sufficient support for this project to proceed.

Recommendation: Approve

The six owners who did not return their ballots were sent a second ballot and still did not respond. Of these six owners five had signed the original petition. If these owners are assumed to be in favour, there is still insufficient support for this project to proceed.

Ballot results: In Favour 10

Opposed 10

Responses 20

Based on the ballot results, a two-thirds majority is not possible as more than one-third of the owners are now opposed to the project.

Recommendation: Not Approve
