   SUBJECT:  Statutory Right-of-Way Northwest Corner Pacific  Boulevard and
             Cambie Street


   RECOMMENDATION

        A.   THAT Council grant a statutory Right of Way to B.C. Hydro over
             a  portion of Lot  109, False  Creek, Plan  20128 for  a hydro
             kiosk.

        B.   THAT no legal relations  are created and no legal  right shall
             arise until a legal agreement drawn to the satisfaction of the
             Director of Legal Services  is executed by B.C. Hydro  and the
             Director of Legal Services on behalf of the City.

        (The granting  of  a Statutory  Right-of-Way  on a  permanent  park
        requires a 2/3 majority vote.)

   GENERAL MANAGER'S  COMMENTS

        The General  Manager of  Corporate Services RECOMMENDS  approval of
        the foregoing.

   COUNCIL POLICY

   The  Vancouver   Charter  authorizes  Council  to   enter  into  various
   agreements concerning land transactions.

   PURPOSE

   The purpose  of this report  is to  obtain Council approval  to grant  a
   Statutory  Right-of-Way to  B.C. Hydro  over Lot  109 False  Creek, Plan
   21028 as per attached plan (Appendix A).  The hydro kiosk involved is to
   serve  both City  Engineering and  the  Marinaside development  in North
   False Creek.
   DISCUSSION

   In 1984,  Lot 109 was conveyed to  the City by B.C.  Place Ltd. for park
   purposes.   The  conveyance  was a  condition  of subdivision  approval.
   Subsequently Lot 109  was developed as park (Helmcken Park).   The Board
   of Parks and Recreation now maintains this "Permanent Park".

   The Manager  of the Park Board has no objection to a Statutory Right-of-
   Way  over the  south west 16.7  m› of  Helmcken Park  containing a hydro
   kiosk.  Park staff have reviewed  the detailed design to ensure that the
   facility is appropriately screened  by ornamental gates and landscaping.
   The Park Commissioners  have approved granting  the Right-of-Way by  the
   required 2/3rd majority.
